He would definitely be replaced by another Republican. Frist would get to pick among the whole Senate Republican caucus for a replacement for Hatch on the Judiciary Committee. It would be our job as FReepers to help him make that selection. Who would we recommend and support?

He is a lawyer, and was on the University of Pittsburgh Law Review back in 1959-1963 or so...(it's been so long since I've seen the plaque that I don't remember).

Just like naming Ashcroft AG after the 'Rats stole the MO Senate election for the widow, make them pay by moving him to an even higher and more important post.
BTW - the same should apply to the Supreme Court - Estrada should be a nominee (after Ted Olsen, whom Krauthammer named as the likely first choice on Fox last night).
That's not what I meant. If Hatch's leaving the Senate would give Frist and the Senate leadership a chance to appoint a more conservative (and less Ted Kennedy-compromised) senator on the Judiciary Committe, would that not be a good thing?

Don't forget the old saying, "Never count your Hatch before he chickens."
1. Hatch stays in the Senate and on the Judiciary Committee for at least two and possibly eight more years while as many as four SCOTUS positions open up.
2. Hatch stays in the Senate and on the Judiciary Committee as Committee Chair (with a wounded Specter nipping at his heels) for at least two and possibly eight more years while as many as four SCOTUS positions open up.
3. Hatch resigns from the Senate, takes over DOJ for at most four years and then retires completely from public life, leaving Frist to appoint an aggressively conservative senator to the Judiciary Committee in Hatch's place and giving the Utah governor an opportunity to appoint a more reliably conservative senator to complete Hatch's term. (and, no, I don't believe Leavitt is the right pick, but that's another story).
