Colorado teacher kicks student for wearing GOP shirt off campus

A part-time college instructor has apologized for kicking a student because he was wearing a Republican shirt. Fort Lewis College student Mark O'Donnell said he was showing people his College Republicans sweat shirt, which said "Work for us now ... or work for us later," when Maria Spero kicked him in the leg at an off-campus restaurant.

But you're right...I couldn't figure out for a second whether or not the teacher was a really hard kicker or whether the school was actually allowing teachers to kick students out of class.

No, technically, it is battery. Assault is a swing and a miss. If you make contact, it is battery. Hey, thanks. I did not know that. I thought the use of those 2 words together was just a redundancy. Learned something! :-)

i believe her. i am sure the kid was a brat too and if he was she overreacted but he shouldn't have done what he did if he did it in the wrong spirit.

I sent her a rather scathing e-mail to which she replied:
"There are two sides to every story. I certainly did not walk across the room to kick the young man, he tauntingly backed up to me with his rear end in my face while I was seated at a table. The unfortunate kick was due to the repulsiveness of the situation. I am paying dearly for it. I feel it is another instance of distortion by the Republicans."
If true, he deserved a kick. If not I don't feel sorry for her probems.

Got a reply from her, too, identically worded.
Here's my reply to her:
Ms. Spero,
I suspect there ARE two sides to every story. I am responding to just what the media reported. The media in this case is AP, not GOP lapdog.
- they did NOT report any provocation such as you describe.
- they reported that the student was showing his sweatshirt to other buddies, not to you.
- your apology, which should really reflect your side of the story, indicates that you kicked him BECAUSE of the political message, not encroachment
- the story indicates that you did not know he was a student.
Some questions arise:
- would you have NOT kicked him if you knew he was a student?
- would you have kicked him "harder and higher" if you were not seated?
- does the phrase "College Republicans" indicate that the wearer has a pretty good chance of being a student?
- does the party of peace (as the Democrats style themselves) advocate physical altercations with those of a different political view?
- You lead trips to Mexico and Honduras. Does the violence in these countries' recent pasts encourage or discourage you from expressing your polical views in such a physical manner?
I have passed these questions on to your department head. I feel that you have not really learned why your behavior is troubling, your dissembling so disingenous, and your inability to absorb this lesson mean that you continue to be a clear and present danger to your students who do not agree with your political worldview.

Battery: Kicking th person. No words are necessary. The application of the physical force is sufficient!
Either is a stand-alone offense which can be prosecuted.

So why would the guy (who she admits not knowing) stick his arse in her face?
I don't believe her story, and at the end she tries to play victim then shift blame to the Republicans.
