Navy:Undesirable/General Discharges for Civilian Misconduct While on Inactive Duty Reserve Status

Until now, it has been the conventional wisdom of former military Freepers, including myself, that any misconduct committed by John Kerry while a civilian in an inactive duty status while still a member of the U.S. Naval Reserves would have had no impact on his discharge status.

I, along with others, believed that, after release from active duty but while still a member of the Naval Reserve, Kerry could only have been held accountable for misconduct while on active duty for training or for previous misconduct committed prior to his release from active duty.

Well, we have all been proven wrong.

On 4 September 2004, I wrote and posted an essay documenting how the John Kerry Official web page had succeeded in deceiving the news media into believing that John Kerry had been “honorably discharged prior to joining Vietnam Veterans Against the War”.

The fact of the matter is that John Kerry still had Ready Reserve and Inactive Reserve obligated service after his January 1970 release from active duty date and was not even eligible for discharge until 16 December 1972.

The Honorable Discharge Kerry received, however, was dated 16 February 1978, during the Carter Administration.

Today, I received Post 155 on that thread from Freeper “rolling_stone” which included a link to Secretary of the Navy Instruction SECNAVINST 5420.174C whose subject is: Review at the Level of the Navy Department of Discharges from the Naval Service.

SECNAVINST 5420.174C

Section 9-1 of SECNAVINST 5420.174C has an extremely important piece of information:

“d. The following applies to applicants who received less than fully honorable administrative discharges because of their civilian misconduct while in an inactive duty status in a reserve component and who were discharged or had their discharge reviewed on or after April 20, 1971: the NDRB shall either re characterize the discharge to Honorable without any additional proceedings or additional proceedings shall be conducted in accordance with the Court’s Order of December 3, 1981, in Wood v. Secretary of Defense to determine whether proper grounds exist for the issuance of a less than honorable discharge, taking into account that:

(1) An other than honorable (formerly undesirable) discharge for an inactive duty reservist can only be based upon civilian misconduct found to have affected directly the performance of military duties;

(2) A general discharge for an inactive duty reservist can only be based upon civilian misconduct found to have had an adverse impact on the overall effectiveness of the military, including military morale and efficiency.

The MSM will move heaven and earth to ignore this. God forbid that the general dumb public put two and two together and come up with four. How would they explain this away? And the fact that Kerry still won't apologize for it.

It's too bad that copies of his file aren't left lying around, ah, but the MSM and Rather would yell 'Forgery' and demand an independent investigation. Never mind the implications of Kerry's behavior.

Just like a pshycopath to project his failures on his oppopnent. I think it was insurance in case his own snafu got out as well.

Even Kerry says he got an early discharge, so obviously he didn't fulfill all of his obligations.

"On Jan. 3, 1970, Kerry requested that his superior, Rear Admiral Walter F. Schlech, Jr., grant him an early discharge so that he could run for Congress on an antiwar platform.

"I just said to the admiral: `I've got to get out. I've got to go do what I came back here to do, which is, end this thing,'" Kerry recalled, referring to the war. The request was approved, and Kerry was honorably discharged, which he said shaved six months from his commitment. "

Call me a traitor but I am a veteran and I say just let it go. Kerry did his service to the country, he will lose because he is not a man of character, so let by gones be by gones.

The Kerry Administration was wrong for going after Bush for his National Guard Service and it does not make us any better going after Kerry because of his Honorable Service.

Now, before everyone goes ape one me, let me say that I strongly disapprove of Kerry's actions after the war, I strongly disapprove and rather angered that he lied about our country, while men were dying in the Hanoi Hilton. He turned his back on his shipmates and his comrades in arms. Obviously, Kerry has no idea what, "Fiedlis" means. However, I do not think it is wise to seek further blood. John Kerry will be judged for his sins by the people, let this one go. We're better then the Left, because we do the right thing.

Notice that CBS, ABC and so on didn't think it's necessary to investigate this.

Kerry has a citation which is a forgery -- Lehman is alive to testify that he didn't sign it, never saw it, and doesn't know anything about it, unlike Killian.

Why isn't anyone investigating it. It is a criminal act to forge an official military document, such as a Silver Star citation.

The problem with that story is that Kerry's Reserve obligated service would not have been completed until 16 December 1972.......That is a lot more than "6 months" after January 1970.

Good lord, I forgot his request for early discharge so he could run for office. His story changes so much...sometimes from sentence to sentence that I'm getting lost!

what really gets me is that if it's true, how can Kerry go out on the stump every day with this hanging over his head? he has to know this is out there, I'm sure he has people monitoring FR and the blogs, and talk radio.

deport says Kerry fulfilled his obligations.

My point was that even by Kerry's own admission, he got out early, i.e. did NOT fulfill his full obligations.

Looks like you have done considerable research on the subject. Perhaps you could address deport's points.

Just what I read shows that Kerry was involved with anti-war activities, while still an officer in uniform.

"One day in October 1969, Peggy Kerry was working in the New York office of a Vietnam War protest group that was planning a "moratorium" peace rally in Washington, which would draw 250,000 protesters one month later. A leader in the New York protest, Adam Walinsky, a former speechwriter for Robert F. Kennedy, said he needed a pilot and plane to take him around the state on Oct. 15. Did anyone know a pilot?

Peggy Kerry said she would provide such a volunteer: her brother.

John Kerry flew Walinsky around New York to deliver speeches against the war. Kerry did not wear his uniform and did not speak at the events, but the experience helped convince him that he wanted to become a public leader of the antiwar movement. Yep.... got an early discharge from Active Duty.... He got at least three discharges....

1] Dec. 1966 when he completed OCS and was separated from the enlisted ranks and commission an Officer

2] Mar. 1970 when he was separated from Active duty and assigned to the Ready Reserves-Inactive

3] Feb. 1978 when he was separated from the Standby Reserves- Inactive

Kerry is counting on the MSM to continue to ignore anything negative about him. Most people, as in probably 80-90% ofthe population get their news from the MSM.
