Document Analysts: CBS News Ignored Concerns About Disputed Bush Military Records

Two of the document experts hired by CBS News now say the network ignored concerns they raised prior to the broadcast of 60 Minutes II about the disputed National Guard records attributed to Lt. Col. Jerry Killian, who died in 1984.

Emily Will, a veteran document examiner from North Carolina, told ABC News she saw problems right away with the one document CBS hired her to check the weekend before the broadcast.

"I found five significant differences in the questioned handwriting, and I found problems with the printing itself as to whether it could have been produced by a typewriter," she said.

Will says she sent the CBS producer an e-mail message about her concerns and strongly urged the network the night before the broadcast not to use the documents.

The absolutely best part of this is that it shows that CBS knew the documents were frauds before they broadcast the story.

Are there any lawyers who can comment on the potential penalty for knowingly broadcasting fraudlent information in an attempt to influence an election?

Update 6:05 p.m.: Late Thursday afternoon, NBC News and CBS News requested that that the Democratic National Committee pull the campaign video in question. The DNC, through a spokesman, says that the matter is under consideration.

NBC released a statement Tuesday afternoon. "The Democratic National Committee (DNC) has included an edited excerpt from a Meet the Press interview with President Bush that was broadcast on February 8, 2004 as part of their promotional campaign to be used as a web video and shown in battleground states. NBC News does not authorize its copyrighted footage to be used for partisan political purposes. NBC News did not, and does not, license use of our material for these purposes and we have asked the DNC to cease and desist immediately from using the excerpt."

CBS spokeswoman Sandy Genelius told THE WEEKLY STANDARD late Tuesday afternoon that CBS, like NBC, will demand that the Democratic National Committee stop using CBS News footage in the new ad. "We do not want them to use the video and we are taking it up with them," said Genelius.

Jano Cabrera, a spokesman for the DNC, says the matter is under consideration. "We are aware of the request[s] and we are looking at it. Our current understanding is that we have the right to use the limited excerpts in the video. But we are looking at it." See the full original story below.

For what? Who has been defamed? What are their damages?

Who has been defamed? Lets start with George Bush, then we move on to Jerry Killian. Well, he's dead, but I bet his widow and son have claims against CBS.

What are their damages? Unknow monetary value, but the whole idea behind libel and slander is damage to a man's reputation.

Of course they knew they were frauds. They probably had just gotten them, from the guy that created and "aged" them.

ABC sees the story, in CBS being a weak competitor.

CBS still hasn't recognized they oughta stop diggin.

Just drove for about 90 minutes. Heard three ABC radio NETWORK newscasts. Anti-CBS stories led all three casts!

Killian's widow's reputation is fine. So is the son's. The only person who has been defamed is GWB.

It's diabolical. GWB can't sue, it's political suicide (and a waste of money, plenty of small time liars out there saying worse, see Kitty Kelly).

Idle speculation on my part, but seriously wonder if Dan Rather and CBS have a legal leg to stand on. Terry McAuliffe said Bush was AWOL, no damages. Al Gore said GWD deserted the country. Many talking heads say GWB lied, about Iraq, about everything. Air America is legal. So what keeps CBS News from being the TV equivalent of Air America?
