Just a headline and I believe they mean that he is no longer going to represent the campaign

This was a stupid thing for Ben Ginsburg to do; I can't believe nobody at Patton Boggs & Blow was familiar with the law.

I love how the GOP just rolls over and surrenders to the media and the Dems.

CNN all over this, reading his resignation letter. He says he simply gave legal advice, which is legal.

Ginsberg shows adherance to principal rather than parsing the "is" question.
and...how many Dem Kerry campaign lawyers have done this working for MoveOn, ACT or any of the other 60's reject grownup groups?
Answer 0.

Correct. As long as he did not divulge privileged material concerning his cleinst and as long as there was no conflict in representing both the campaign and the Swifties (there wasn't), then he did nothing illegal.

And how do you know the GOP "rolled over"? Ginsburg could have easily decided to leave on his own or been asked to by the firm where he works.

They are not rolling over -- when someone makes a mistake that they should know better on, then they are removed. I call it ethics not rolling over. Ethics are in short supply in DC these days and nice to see that the Bush Campaign has no intention of using a double standard no matter who it is.

So just giving legal advice is okay? That's what CNN is saying?

I don't think it's a rollover...he's acting on principle and removing the potential conflict of interest, and removing an attack potential for the Kedwards campaign and their Gunga Dins in the MSM.

What WILL be a rollover is if the GOP doesn't start going HARD after the Johns to have their dual-role DNC/527 operatives do the exact same thing--resign. One of the ABC Radio News broadcasts this morning did mention that the DNC had several people on staff that also worked for/with moveon.org, ACT, etc...no idea how THAT one got past the commissars---errr, editors.

What do you mean? Although there was probably nothing illegal about it, there is an appearance of impropriety. Far better simply to remove the appearance, than to blow it up into a losing battle.

part of the letter, from DJ:

"I cannot begin to express my sadness that my legal representations have become a distraction from the critical issues at hand in this election," Benjamin Ginsberg wrote in a resignation letter to Bush released by the campaign.
"I feel I cannot let that continue, so I have decided to resign as national counsel to your campaign to ensure that the giving of legal advice to decorated military veterans, which was entirely within the boundaries of the law, doesn't distract from the real issues upon which you and the country should be focusing."

The appearance of impropriety is reason enough for him to leave. It is the right thing to do but he will be missed by the campaign.

It is legal but not very ethical because the President's campaign is not to have anything to do with 527's. The President plays by the rules unlike the RATs and Kerry. When you are a legal advisor to BC'04, you better watch your step because they will not put up with any perceived conflict of interest.

Dumb move on Gingsberg's part if you ask me.

Does this mean he is going to be working exclusively with the Swift Vets?

Deep breath time, Rose -- do you really want to start a loud and losing battle in the MSM over Ben Ginsburg, and thus give much-needed traction to the currently stuck Kerry campaign?

Because that is the alternative that your rather silly post implies.
