A sit-down with the governor (CA gov. Arnold amends his positions on illegals' services)
Sacramento Bee ^ | 8/11/04 | Margaret Talev

SANTA FE, N.M. - Gov. Arnold Schwarzenegger said Tuesday that he is unlikely to support a push by some fellow Republicans to bar the Legislature from granting driver's licenses to undocumented workers in California and to cut off their access to government subsidies for housing, food and higher education.

"I think it's old hat," Schwarzenegger said of the proposal, which some conservatives hope to place on the ballot by 2006, during an interview following a two-day conference with governors from Arizona, New Mexico, Texas and six Mexican states along the U.S. border.

-snip-

In 1994, Schwarzenegger was among a majority of Californians who supported Proposition 187, which sought to limit illegal immigrants' access to government services. Most of the initiative was later thrown out in court.

Earlier this month, a group of conservative Republicans said it would push a ballot measure to bring back some of those limits in a fashion the courts could uphold, and to block lawmakers from granting licenses to undocumented drivers.

Schwarzenegger said Tuesday that while he had not studied the plan, it did not sound like something he would want to support.

"We should find ways to work together rather than to find ways of going the other way," he said.

Please tell me How they are going to vote with a yellow tinted license that is emblazoned with MEXICAN CITIZEN on it.

Well, that iuulstrated the whole asburdity of the point. Nobody should have a US state issued drivers license with ANYTHING CITIZEN on it it .... aside from US CITIZEN.

What next CANADIAN CITIZEN, AUSTRALIAN CITIZEN, CITIZEN OF THE REPUBLIC OF CONGO ....

Your country of citizenship is supposed to be the one issuing licenses.

A *different* driver's license, however, is not only acceptable, it is a thing of beauty.

Good Luck, on this *different* type of DL....

Here you see Tennessee spent much time, effort, & TAXDOLLARS to issue illegals a *different* type DL.

Six weeks later the usual suspects filed a lawsuit claiming these *different* licenses were *discriminatory*.

"This is about Motor Voter!!! After they get the paperwork for a driver's license then they will be able to go to the next window and register to vote..."

How do they get to register to vote with a yellow tinted driver's license stamped "MEXICAN CITIZEN"?

So what?! People file junk lawsuits everday.

NEWSFLASH: it is *legal* to discriminate based upon citizenship. In fact, for many things, it is *mandatory* to discriminate based upon citizenship.

Why don't they just get the license from Mexico?

They could probably get an international driver's license if they were that conciencious.

Why does a US state need to issue one?

"Are all of a sudden folks who have thumbed their nose at every US law in their path, are suddenly going to grow a civic concious and beat a path to the local insurance company so that they may follow the letter of the law. Come on, guys. Take a few moments and think it out."

Have you ever tried to get a building permit without insurance?! The bureaucrats won't *give* you the permit until you first show proof of insurance.

The same can be done for showing proof of insurance to get a driver's license.

"Why does a US state need to issue one?"

One presumes that a U.S. state would want to issue such licenses as a way to register currently anonymous illegals with the government, verify that illegals have proper insurance, and that they are paying their proper taxes.

Outside of those reasons, it probably boils down to politics, which you had better learn to become good at if you don't want the illegals to beat you at that game on your own home turf.

No, I can't say that I have. I've never tried obtained a building permit at all. I've always lived in the inner-city, and we don't get to "build" much here.

The bureaucrats won't *give* you the permit until you first show proof of insurance.

I'll take your word for it.

The same can be done for showing proof of insurance to get a driver's license.

Why don't they get a license in the country of nationality?

And in Cali, it is required to have insurance to drive a vehicle. The illegals just thumb their nose at the insurance AND licensing laws AND the immigration laws AND the employment laws (if they have a job of any sort).

You mentioned "illegals" twice in the paragraph above. Illegals mean that they have broken one or more laws of the state and/or country. If they are currently driving, they have broken multiple laws. "Illegals" should be "issued" nothing except for deportation orders. That's why they are called "illegal". The alternative is to strike Federal Immigration Law from the books. I'm not sure if this is what you advocate, but i'm not for that.

Outside of those reasons, it probably boils down to politics, which you had better learn to become good at if you don't want the illegals to beat you at that game on your own home turf.

I shouldn't have to "beat" illegals at anything on my "home turf". My government and elected officials should be enforcing Federal Immigration Law (and licensing, insurance and employment law).

Not for a while yet, sorry, but at least my family members stopped moving out of that state. They're very pleased with the changes Schwarzenegger has made to start turning California around.

For once I have to agree with Southack because what he's saying is actually working out in my state of Tennessee. Not only are we getting a database of illegals (while the Feds aren't), we've put a stop to the MotorVoter baloney.

The illegal advocates received what they literally asked for (a document to drive with) while being denied what they really want (a document to pass as a citizen). I think this halfway measure is on the right track if the howls from the advocates are any indication.

Check this out for yourself.

Drivers Licenses isn't even half the issue. The fact that he won't support cutting off other Freebies to illegals will sink this state. I'm sure his big financial donors (aka Special Interests) are in glee as they make millions off the housing subsidies for the poor (illegals) and other social programs.

Driver's license law discriminatory, federal lawsuit says

By ANITA WADHWANI
Staff Writer
Middle Tennessee News & Information

State's immigrants, Hispanic residents claim new policies unconstitutional

Tennessee's new driver's license law discriminates against both immigrants and Hispanic residents, and it clearly violates the U.S. Constitution, according to a federal lawsuit filed yesterday.

Last week, Geraldine Gurdian's Nicaraguan passport, Florida driver's license and permanent residency card were confiscated by a clerk who said ''you don't even know English'' when she tried to get a driver's license at the Hart Lane station in Nashville, according to the complaint.

She was among plaintiffs in a lawsuit filed in U.S. District Court that claims the state's unique new law ''exhibit(s) a deliberate indifference'' to the constitutional rights of immigrants and Hispanics and a ''pervasive pattern'' of discriminatory actions in day-to-day operations at driver's license offices.

Under the 6-week-old law, driving certificates will be issued in place of driver's licenses to temporary and illegal immigrants. Good only for driving, they'll say ''not valid for identification.''

Neither Department of Safety Commissioner Fred Phillips nor his spokeswoman would comment on the lawsuit and refused to answer even general questions about routine departmental policies.

''To the policy itself, what this governor is trying to achieve is a common-sense approach to balancing the needs of public safety and homeland security,'' said Lydia Lenker, spokeswoman for Gov. Phil Bredesen. Lenker said she couldn't comment on the suit.

The driver's license law has been the subject of national attention since the governor signed it into law in May.
The policy creates two types of driving documents: driver's licenses for those who can prove they're either citizens or legal permanent residents, and driving certificates for those who can't. Stamped ''not valid for identification,'' certificates are intended to be used only for driving and not to board a plane, buy a gun or rent a car, according to policy-makers.

Bredesen has called it the ''strictest driver's license law in the country.'' He also has said it addresses national security concerns by barring all but citizens and legal, permanent residents from getting a valid state license, and it ensures that everyone on Tennessee roads — including illegal immigrants — is qualified to drive.

The attorney filing the suit, Jose Gonzalez, disputes that.
''Despite their assertion that homeland security is a compelling interest, I think their real reason for this law is that they don't like illegal aliens getting driver's licenses,'' said Gonzalez.

Gonzalez cited another plaintiff who sought a state ID for her 8-year-old Mexican-born son as an example. Minors are eligible for state IDs, Gonzalez said. When Yolanda Lewis' son was turned down, she was told he would only be eligible for a driving certificate and then — when she pointed out his age — was refused any document at all.

''On what basis do they deny an 8-year-old child an ID? On what basis do they show that this child is a national security risk?''

''They have the burden of showing that this really addresses homeland security. And they haven't.''
Gonzalez will be seeking a preliminary injunction later this week to stop the state immediately from issuing any more driving certificates until a judge rules on the lawsuit. He also will ask that the suit be considered a class-action suit applying to all immigrants and Hispanic residents who might be affected by the law.

The suit challenges two other state policies as well: one is a year-old law banning Mexican consulate identity cards — but not those from any other country — as valid identification in applying for driver's licenses and state IDs.

The 25-page lawsuit also singles out state laws that leave it up to individual law enforcement officers to decide what they'll accept as proper ID; such laws are so ''vague'' they're unconstitutional.

Since the new law went into effect, police departments have said they will decide individually whether officers will accept certificates as ID when issuing citations for traffic and other minor offenses. Police can take someone into custody for lacking proper ID. That, according to Gonzalez, is contrary to a Supreme Court ruling that says police and the public need guidelines about what ID is acceptable.

The law ''doesn't tell us as residents of the state of Tennessee what documents to carry that will satisfy Tennessee police officers,'' Gonzalez said. ''We won't know until officer A stops us and tells us and then police officer B stops us and he tells us something else.''
The suit also calls Department of Safety staff poorly trained, inadequately supervised and says that incidents such as the one with Gurdian — who ultimately had her passport returned — were not adequately investigated. It also accuses the Department of Safety of violating federal law and risking federal dollars by not providing interpreters at testing stations.

Yesterday a Department of Safety spokeswoman refused to comment on their interpreter policy, their policy regarding minor children, the training of their staff or their policy on confiscating documents, citing the pending lawsuit.
The suit will go next before a judge, but no date has yet been set.

Let me know when you people "wise up"...
This has nothing to do with "driver's licenses"
This is all about the 'Rats running a scam to get illegal aliens the right to vote!
Hellooooooo

I'm surprised that the RINO's are clamoring to tell Ah-nold that he is giving them a bad rap. I think Ah-nold is even too liberal for the mainstream RINO's.

I had one happen to me and no drivers license to prove he understands CA laws, and couldn't speak English.

I don't care if the person is an American, a legal immigrant, or an illegal alien, if you don't have a driver's license, stay the hell off of the roads.

So who is winning, the illegals or you?

The illegals.

I make my views known to my lawmakers, however, they do not care.

The fact that the illegals are winning is the product of corruption in the government, not be a shortcoming of the minority who are aware of said corruption.
