I linked to this through Urban Legends while researching a web hoax. If you go directly through http://www.johnkerry.com you have to sign up to get in, which I was not about to do!

Ok, if Kerry was discharged in 1978 from the Naval Reserve, why wasn't he charged under article 104 Sec (2) "Aiding the enemy" of the UCMJ?

He did enter into private talks with the leaders of the Communist party of Vietnam, during his visit to Paris during the Paris Peace talks.

Kerry's supporters treat swift boat duty as like being in a B17 bomber crew. No one else can see what goes on inside the aircraft. From any reading about the Browm water navy, it appears the the Swift Boats always operated in groups, providing mutual support against hostle fire. In this way a boat's movements and the decisions of its commander were open to the observation of experienced naval personnel.

Most Americans if they even heard of Swift Boats know them in the Apocalypse Now theatric. That, I believe , was not their method of deployment. Also, given Kerry's limited time in country I think it unlikely that he would be often entrusted on go it alone missions.

All this IMHO shows that there are valid reasons to consider the charges of these veterans.Whether the accusations are true I cannot say. I wasn't there, but since Kerry has highlighted his four months in Vietnam as the centerpiece of his candidacy, accusations that his service was less than he claims are worthy of close scrutiny.

Requesting Previously Denied Unit Records

After twelve years unit-assignment information is suppose to be unclassified. Thus, if you have been denied a copy of your unit records and twelve years has elapsed, you may be able to obtain them now by following the directions below:

Write to: Chief, Research and Rulemaking Branch Records and Management Division Dept. of the Army Office of the Adjutant General Alexandria, VA 22331

Be sure to include your name, your unit assignment, service number, and the dates and places you were assigned to. Request the extracts of the "Operational Reports - Lessons Learned" that were submitted by your Division, as well as the staff journals-after action reports.

U.S. Vertan Information

Kerry's personnel records will not really tell you to much about what happened. Someone who was with Kerry should request all opertional and after action reports.
