Prosecutors: No Dice on Berger Deal

Justice Department prosecutors have reportedly rejected several offers from former National Security Adviser Sandy Berger's lawyer to resolve the department's eight-month long investigation into his illegal removal of top secret documents from the 9/11 Commission's reading room.

Two sources associated with the investigation told CNN that lawyer Lanny Breuer made a detailed statement of Berger's view of the facts at issue several months ago. According to the unnamed sources, Berger has offered to talk to the Justice Department about a resolution to the probe.

In the intervening months, Breuer has renewed Berger's offer to come clean several times.

But in a bad omen for the former top Clinton national security official, the Justice Department has repeatedly rebuffed the offer and refused to enter into any discussions.

Instead, Deputy Attorney General James Comey warned Tuesday that Berger - who resigned hours ago as a top campaign advisor to presidential candidate John Kerry - could face jail time.

"It is against the law for anyone to intentionally mishandle classified information, either by taking it to give to somebody else, or by mishandling in a way that is outside the regulations of government information," Comey told reporters in Washington.

"We take issues of classified information very, very seriously," he added.

"It's our lifeblood to keep secrets. All felonies in the federal system bring with them the promise of jail time," Comey stressed, adding cryptically, "That's all I can say about that."

As U.S. Attorney for New York's Southern District, Comey oversaw the indictment of Martha Stewart for lying to federal investigators. Stewart was sentenced to five months in jail last week.

Any charges would come out of Ashcroft's Office?? Yes. But noticed that Ashcroft, who usually takes the stage, has said nothing. Ashcroft is a no nonsense, straight, real brain. He was pretty explicit during the 9-11 hearings that "something is wrong here". We NEVER received what Clarke and Berger said we did.

So, Sandy Berger will tke a bullet for Bill & Hillary! The Clintons must have something on him big time, like maybe he gets turned on by licking dogs toenails. This guy knew what he was doing, make no mistake about, just like Martha Stewart knew what she did was a criminal act (Lying to save her butt!) These people believe they are above the law!

I'm in the military and have a TS clearance. When my investigation started for my clearance, I had to sign a non-disclosure agreement, stating the severe penalties for (1) willfully removing classified information from a SCIF (Sensitive Compartmented Information Facility), and (2) disclosing it to other individuals. Obviously, the latter is much more serious and if Berger gave ANY of the information to ANYBODY from the Kerry Camp, he'll do jail time.

I hope somebody is keeping a watchful eye on Berger -- at least until he's through talking. It would be a shame, yet not surprising, to wake up one morning and read that Berger committed Arkancide before getting his chance to bargain for a shorter sentence.

They have to have a tape and lots of tapes by now...because the guy is talking and this wouldn't have gotten out until they had enough to prosecute.

1. Was Berger acting at Clinton's urging when he filled his jacket, pants and socks with Top Secret paper?

I would think he had as much reason to protect his own "legacy" as Clintons. Also, if the missing items were "drafts", damning information wouldn't be in those that Clinton would have read-he'd read only the final version.

2. Did Clinton broker Berger's services to the Kerry campaign? If the answer to the latter question is "Yes", then Kerry knows he's been had. And that his campaign is well and truly sabotaged -- and he'll be fighting a two-front war until November.

Very interesting. Obviously the Feds would have contacted Clinton since Berger was working for him. And Berger was also working for Dean at that time. It would be interesting to find out when Berger came on board for Kerry - and if Clinton suggested him at that time. Yes indeed, good ideas.

They don't say which "law enforcement sources", that could be anyone who has anything to do with law enforcement anywhere. Obviously not anyone connected with prosecuting this case. More media deception.

That is the issue here. Berger knew he would be caught, but he was willing to take the fall. WHY?? What did he destroy?? I'm afraid that the frenzy over his guilt will overshadow what he destroyed and who else was involved. He is willing to fall on the sword for BC and the Dem Party. We'll probably never know the whole story. Berger will be the scapegoat and the Repubs. will be happy and soon it will be yesterdays news.

The only thing I don't get about this whole thing is that EVERYTHING is also on soft-copy nowadays, so there would be no point to destroy hardcopies. MY theory: inside info. for Kerry operatives. Kerry doesn't need the information himself; he has a clearance and can read the reports in a SCIF (Sensitive Compartmented Information Facility) on Capitol Hill whenever he wants. But of course Kerry would never sneak out docs himself (too risky). So we come to Sandy...

I wish klintoon would be indicted for conspiracy in this matter. If, the FBI does it's job maybe we will see teflon fade from sight. Thank God, the park police aren't handling this investigation. Remember (Vince Foster) Berger will roll over like hubbell. Bush/Cheney 2004.

"How did this stay quiet for eight (8) months? That answer is almost as interesting as to what is still missing.

Possibly because Berger hoped to cut a deal. When that became impossible, his only chance was to turn it into a media circus in the hope of escaping under the cloud of 'partisan persecution'.
