Rumsfeld has prisoner held 'off the books'

Washington - United States Defence Secretary Donald Rumsfeld late last year ordered a member of the Ansar al-Islam militant group captured in Iraq be held in secret, in possible violation of international law, NBC News reported on Wednesday.

The prisoner was captured in Iraq in July and flown by the Central Intelligence Agency to an undisclosed location outside the country for interrogation, NBC reported, citing unnamed Pentagon officials.

The prisoner was returned to Iraq four months later after the US justice department suggested it might be illegal to hold him outside the country.

Rumsfeld then ordered the prisoner be held "off the books", hidden from the International Committee of the Red Cross, NBC said. He is still being held incommunicado, NBC said.

In the military's own investigation into prisoner abuse, Major General Antonio Taguba said efforts to hide prisoners from the Red Cross were, "deceptive" and a "violation of international law".

Pentagon officials told NBC keeping prisoners in secret is legal if they pose an immediate threat. They said Rumsfeld did not break any laws, but admitted the law could be interpreted in other ways.

If they are terrorists. . .Geneva doesn't apply, and the Red Cross has no LAWFUL interest.

Mind you, the International Red Cross DOES appear to have an interest in damaging and /or embarrassing the US. . .but that's irrelevant to the legal issue at hand.

Terrorists? Drug 'em, milk 'em for all the info they have, then a bullet to the back of the head and drop 'em out of a cargo plane over the open ocean. . .

The Red Cross takes an asymethical approach to the democracies and to the despotisms. They let Saddam Hussein get by with horrific treatment of his people because he would simply have kicked them out of the country if they had embarrased him. But the democracies get hit over the head for actions that pale by comparison.

The liberals are going after our ability to extract information from these people. They understand that information is absolutely key to winning this war.

If the American people buy this garbage, our ability to fight this war and to prevent future attacks will be in serious doubt. You can bet, however, that the pig Stalinists will never be blamed, just as they weren't blamed for destroying our intelligence gathering capability prior to 9/11.

I continue to deny that there is any such thing as "international law" - or at least to deny that it is possible to violate it, whatever "it" is.

Law is an attribute of sovereignty. Law requires a lawgiver.

Article I, section 1: " All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives."

Therefore, nothing which is not passed by the House of Representatives and the Senate can possibly be a law.

In the case of "international law", who or wht is the sovereign lawgiver?
