Just announced over the radio that the MO Supreme court has ruled that the Secretary of State "SHOULD" put the amendment on the August ballot. But did not order him to do so.

For those outside MO, what does the amendment do?

The amendment defines marriage as a man and a woman. It basically bans gay marriage.

It at least guarantees Bush will win Mo., because it will bring out conservatives to vote.

That's just it. The Missouri Supreme court "ruled" that the Missouri Sec. of State (Blount) SHOULD (key word) put the amendment banning gay marriage on the August primary ballot (when much fewer vote).

But they did not "order" him to do so. Effectively leaving it up to him. The Republicans want it on the November ballot when the turnout will be much higher. The Dem's want it on the August primary ballot.

Watche them carefully or they will word it something like: "Shoud the Missouri state Constitution be amemded to include the 'Same Sex Amendment'", or something equally vague that would confuse a lot of people.

Well, Matt Blunt's argument was that since he was not given the official, signed proposed amendment, but rather copies, it didn't satisfy the letter of the law. So I think we can gather, without reading the opinion, that the Motown Supremes ruled "Ain't nothing like the real thing".

High court decides on August election

JEFFERSON CITY _ Secretary of State Matt Blunt should place a proposal to ban gay marriage on the Aug. 3 election ballot, the Missouri Supreme Court ruled Thursday.

In a 6-1 decision, the high court ruled in favor of Attorney General Jay Nixon, who had challenged Blunt after the secretary of state refused to place the proposed constitutional amendment on the August ballot as Gov. Bob Holden had directed.

However, the court did not grant Nixon's request to issue a writ of mandamus, which would force Blunt to put the issue on the August ballot.

Instead, the court said Blunt “has a duty to take such actions as are necessary, in an expedited manner, to prepare SJR 29 (the proposed amendment) for submission to the people of Missouri at the Aug. 3, 2004, election in accordance with the Governor's proclamation.”

Judges added that, “if any further relief is required . . . the action can be brought directly in this Court.”

Well good luck. I voted for it in California a few years ago, and you can see where we are now. The state supreme courts is still trying to make up it's mind if it is OK for a mayor to overrule the majority of us that voted for it.

JEFFERSON CITY, Mo. - In a victory for the Democrats, Missourians will vote in August - not in November - on a proposed constitutional amendment to ban gay marriage.

Under pressure from Missouri's Supreme Court, Republican Secretary of State Matt Blunt agreed Thursday to put the measure on the ballot this summer.
