Received another letter from Gannett Publications, publisher of USAToday, and several other newspapers. Due to contractual arrangements they have with third-party content providers, they have denied our request to allow posting of excerpts. They will only allow the posting of titles and links.

How about a yahoo website set up specifically just for such articles? Instead of linking to the newpaper or publication, posters could link to the site after posting the article there.
There are several such sites set up specifically for photos, but there's also messages and documents area too. Here's an example of what I mean:

But wouldn't you have to be able to prove that Gannett was being exclusive in it's refusal to allow FR to post even excerpts? Not that that's hard to do, but it would probably be a big factor in winning a lawsuit, especially if leftist sites like the DU ARE being allowed to post the articles without repercussions.

I emailed a large Midwest newspaper about a particular Left-wing website which posts full-text articles from their rag. I pointed out that their copyright policy (which of course they have fully enforced against us) forbade such activity, and provided 3 specific links from within the last month. The upper level contact emailed me back that preventing such activity was very difficult, and would probably take almost a year to correct.
His email was clearly a lie.

This just tells me one thing: that Free Republic has gotten really powerful. It used to be that we had to write to the author of the article to register our like or dislike. Most of our mail would be filed in box "13," and no one else got to read it.
However, when an article is posted at Free Republic, ALL the world gets to see who is weighing in which puts the article AND the author up for scrutiny!
They are running scared!

A couple of questions:
Legally, what is the definition of an excerpt? Is there some minimum requirement, e.g., # of words, % of total words, # of contiguous words?
Must this limitation be universally applied, i.e., applied to leftist sites, to to have legal force (if, indeed, it does have legal force)?

Once they stop Free Republic members from posting news from all over, then it is OVER. We'll not be able to read the REAL news from all over, we'll also not be reading the fill-in news of others' commentary. We are quickly heading to totalitarianism. I am not opposed to that to tell you straight up. However, I would rather it be someone with a philosophy more aligned toward a Bible-based philosophy. And, by the way, it is time to start some harsh action toward those who advocate immorality, killing innocents and evil in general. It's time.

Well, I went back and read through my journalism law book (from ~10 years ago) and there wasn't a specific listing of what constituted an excerpt for fair use.
One section mentioned 2-3 paragraphs, and another specifies four factors:
*purpose and character of the use
*nature of copywrited work
*amount and "substantiality" of material in relation to work
*effect of use upon the market (community)
I'm not impressed with Gannett specifying not even excerpting, 'cept to highlight hits for their information and/or getting hits on their sight for advertising purposes.
'Bout the only one I'm not thrilled with is the Nashville paper. Oh well.
I wish Jim did have deeper pockets to fight this battle, which seems to really just gearing up.
