Received another letter from Gannett Publications, publisher of USAToday, and several other newspapers. Due to contractual arrangements they have with third-party content providers, they have denied our request to allow posting of excerpts. They will only allow the posting of titles and links.

Please do not post full text or even excerpts from the following Gannett Web sites:

I realize it might not fit under any kind of "equal protection" issue

. . . but

LAWYERS . . . ISN'T THERE SOME EQUAL TREATMENT SOMETHING that could be pursued vis a vis such lopsided press treatments?

This is not any kind of free press such as I've ever construed it!

How about paraphrasing with no attribution. Rewrite, cut and paste and totally screw the story with some democrat sarcasm.

If we don't link to them, honestly how are they ever going to know? Just paraphrase their stupid stories, and don't attribute. Seems pretty simple. But really paraphrase or people will get harrassed over it.

I'm not sure about those sewers, but I do know of one Lefty site that posts full-text, with no repercussions.

Another site (which is mostly populated by anti-Bush liberals and anti-U.S. Eurotrash) where I'm a member allows posting of full articles as long as the author and publication are given credit and a link is provided to the site from which it came. I've reported this to the Washington Compost and LA Slimes but so far neither site has done anything about it.

I'll start reporting them if any of these sites are used and we'll see what happens. Somehow I don't think anything will come of it.

So you cut and paste one of their articles into an email. You email it to someone you know (can you say 2nd screen name). Who posts it as an email that they received over the net. No link, nada. How could any court expect Jim or any any other similar operator to know that this article came from a Gannett web site?

Yep. Cite source as "email" and author "unknown". What can they do about it?

I think we must not be slippery at all.

If there is something that HAS CLEAR LEGAL PRECEDENT,

that would be one thing. But even for moderators to try and police the paraphrase stuff--would quickly be a nightmare.

Having taught English for 16 years, I don't trust very many people's ability to paraphrase much at all. Many haven't a clue what it means. We'd end up with wholesale quotes with a few minor changes and someone calling that a paraphrase.

They have us in a untenable position.

We cannot afford to defend against suits.

There is a way to post everything in an article without plagerizing and copying, but it requires a careful re-write.

Hard news articles are easy to paraphrase but editorial comment is not.

We will just have to do the best we can.

Print media is having a hard time and is protecting it's content while gleefully enjoying screwing with us.

We can't do anything about it now.

We do need to see if we can start some sort of legal fund, but that is difficult to do without someone claiming something, as I have seen in the past.

We will just have to roll with the flow until someone brings a case that clarifies this matter.

If we have to become a blogger site, then so be it!
