  or surrogate from withholding or withdrawing nutrition or hydration

Today, the Second District Court of Appeals affirmed Judge W. Douglas Baird's decision for venue in Pinellas County in the matter of Schiavo v. Bush. That means that this case will remain in Pinellas County and in Baird's court. You will recall that Judge Baird had stated the Terri's Law, the law that enabled Governor Bush to intervene and restore Terri's sustenance, is 'presumptively unconstitutional'.

Additionally, Michael Schiavo, through his attorney, George Felos, has asked that Judge Baird issue a summary judgment on the constitutionality of Terri's Law, without allowing Governor Bush discovery or the ability to take depositions.

Today's action by the Second District Court of Appeals paves the way for Judge Baird to summarily pass judgment that Terri's Law is unconstitutional.

It was all a "fix" from the start. The FL judiciary is too corrupt to allow justice in this case and probably many other cases as well. How do Floridians tolerate this "court"?

Hi, tr, meant to add you to that post as we seek positive effective action for Terri and her family.

JebBush@myflorida.com -- Gov. Bush knows what's going on. I'm letting him et al know I am concerned and angry that Terri is still being mistreated and her family is STILL left in the dark on her medical info. Lots CAN be said, and to many different people -- best for me to do what is on my mind to do, or what is mentioned by those close to Terri's fight for the BEST actions.

Recently, Cheryl Ford RN (Fight4Terri@aol.com) wrote a letter to Pres. Bush, which many of us signed.

I really think we would have a better chance of getting the oversight agencies involved if we signed a letter as a group of concerned citizens requesting the various organizations to step in and help Terri. Something similar to Cheryl's letter, but specific to the organization we want to get involved.

Post 19 has the list of agencies. When I called I got tongue tied. A letter written specifically to the four organizations and sent certified would carry more weight. I have seen some excellent posts here laying out all the crimes committed against Terri. Maybe we could have some Freeper volunteers to write one of the letters for each of the organizations, especially anyone familar with the organizations. I know there are better letter writers out there than me. The writer could post the drafts and let other freepers add any forgotten violations of Terri.

I know that all our individual letters, emails, and phone calls helped get Terri's law passed in the first place, but most of them went to politicans, who have to worry about their image a lot more than some nameless employee at these agencies who will just ignore us if we don't put some clout behind the letters.

If enough think this is a good idea, we need to start a dedicated thread for the letters.

If most Freepers think it is better to send the letters individually, I would appreciate some of the letter writers posting their letters so that the rest of us can use them as templates for our own letters.

Cheryl just had us send our name, state, and any added comments to her email address and she planned to add that to her letter, but we have had other online petitions started here at Free Republic that seemed more secure with our information.

We would have to figure out the best way to handle this for security. Most of us have given out our information to Terri's website, so it would be nice if they would host the letters and send them on.

phenn is one of Terri's volunteers, so she may be able to help us there.

Thanks for running with it.

I really like the fact that you are going after the form letters rejecting any requests for an investigation into Terri's situation. That way we can see how to formulate a letter that will be hard to ignore.

We probably need a new thread for the letters. Would you start one?

At no time during the hearing did the Governor's counsel object to the trial court’s jurisdiction or Mr. Schiavo's failure to effect personal service on his client. Instead, counsel proceeded to argue the merits of the injunction and requested a briefing schedule.

Is my memory faulty, or is that an outright lie? I thought Bush's lawyers argued about both improper venue and failure to serve papers.

Just a crazy thought but is there anyway all of us Freepers could join in a type of class action case? I would gladly chip in to help with expenses if such a thing were possible. Maybe we could go after Michael?

Received the following E-Mail today:

BREAKING DEVELOPMENT IN TERRI'S SITUATION

On April 20, 2004, Attorney Deborah Bushnell (who represents Michael Schiavo) faxed a letter to Attorney Patricia Anderson (who represents Bob and Mary Schindler, Terri's parents).

In that letter, Ms. Bushnell stated that Terri has had five teeth extracted. Ms. Bushnell offered no reasonable explanation of why this was done, if Terri was appropriately anesthetized, what follow-up care is being prescribed nor if any restorative dental work was to be provided to her.

For years, in court, Terri's family has argued that Terri's husband, Michael Schiavo had not provided her proper dental care - among other things. Now, Terri has had five teeth removed.

As of this writing, it is unknown what, if anything, is being done to address this problem. Terri's parents are unable to get clear information regarding their daughter's condition.
