Judge Denies Immediate Stay of Gay Unions

SAN FRANCISCO (AP) -- Gay and lesbian couples won another reprieve Friday when a judge declined to immediately stop San Francisco from granting them marriage licenses, saying conservative groups failed to prove the weddings would cause irreparable harm.

A superior court judge in San Francisco has ruled that gay marriages in the city can continue.

Two groups opposing the weddings filed lawsuits to stop the flood of ceremonies at city hall. But Friday afternoon, a judge denied their request to issue to temporary restraining order, saying there was no proof the marriages would cause "irreparable harm."

The judge also consolidated two suits against the city, and said the attorneys should work out when the next hearing would be held.

Thursday, San Francisco filed a lawsuit of its own against the state, challenging the constitutionality of a state law prohibiting same-sex marriages.

Meantime, a new statewide poll finds support for gay marriages rising, though a majority still oppose it. The Public Policy Institute of California found that 44% support the gay weddings, up from 38% in 2000.

Since San Francisco began issuing the altered licenses last Thursday, nearly 3000 gay and lesbian couples have been married at City Hall. Now, a county in New Mexico has started issuing same-sex marriage licenses.

A setback but perhaps technically correct. It won't make much difference if the marriages are banned today or invalidated in 60 days.

Still, I expect the California courts to uphold gay marriage and tell the legislature to legalize it. We need a Constitutional amendment post haste.

From the states, the rogue tyrant mayor of San Francisco, Gavin Newsom, continued issuing "gay marriage" licenses to the queerly beloved. He did so in willful violation of a state law defining marriage as only for a man-woman couple, and in willful violation of his oath of office, during which he swore to uphold those laws. Hmm, kind of makes us long for the days when uber-politico Willie Brown was SF mayor.

Legal challenges to stop this runaway pro-homosexuality lawlessness were delayed until later hearings, starting today. Mathew Staver, president of Liberty Counsel, who is representing the Campaign for California Families in one of the suits, had this to say: "What's happening is not only a violation of civil law, but a violation of criminal law as well." Were California a state that still respected the rule of law, Mayor Newsom would be cooling his heels in a jail cell right now.

Indeed, under the California Penal Code, Section 359 and 360, both issuing invalid marriage certificates and officiating at unlawful weddings are crimes. Section 359 states, "Every person authorized to solemnize marriage, who willfully and knowingly solemnizes any marriage forbidden by law, is punishable by fine of not less than one hundred nor more than one thousand dollars, or by imprisonment in the County Jail not less than three months nor more than one year, or by both."

Cooler heads seem likely to prevail, though, as the state agency responsible for recording marriage records will not record those that have been altered -- specifically where the words "husband" and "wife" have been scratched out. Said Nicole Evans, spokeswoman for the California Health and Human Services agency, "[I]f it [the standard state marriage-application form] has been altered in any way, then it will not be registered and recorded. It will be sent back to the county of origin. We have to follow the law when we process these forms. It's part of public statute, so we are following state law in the way we record and register marriages."

Unfortunately, homosexual advocates have won a victory of sorts because visuals of their errant pathology have spilled into the living rooms of any household tuned into the 24-hour news cycles. Of course, there is a law of unintended consequences....

SAN FRANCISCO - A judge ruled this afternoon that the city may continue issuing marriage licenses to gay couples at least until Tuesday, when he will consider the issue again.

Superior Judge James L. Warren said he found no exceptional circumstances to warrant an immediate halt to the licensing, which has drawn hundreds of gay couples to the city.

The Arizona-based group Alliance Defense Fund had sought the judicial order blocking the licensing.

At 11:45 a.m. Robyn and Leanna Hamilton of Alameda waited pensively with their 3-year-old son Christopher.

They were among hundreds of gay couples who trooped into City Hall on Friday seeking marriage licenses.

"We don't impose our beliefs on them" Roby Hamilton said of the Family Campaign members. "We don't ask them to live up to our standards."

The Hamiltons said they decided Thursday to marry today, the second day that San Francisco has issued marriage licenses to same sex couples in defiance of state law.

Hallye Jordan, a spokeswoman for Bill Lockyer, said the Attorney General's Office will not be involved in the proceedings at this point.
