S.F. to Sue State Over Gay Marriage Ban

SAN FRANCISCO - After sanctioning more than 2,700 gay marriages in the past week, the city said Thursday it is suing the state of California, challenging its ban on same-sex marriages on constitutional grounds.

City Attorney Dennis Herrera planned to file the suit in the afternoon, said his spokesman, Matt Dorsey.

Two judges already are considering challenges from conservative groups seeking to halt the marriage spree that began last Thursday. The city's lawsuit asks that those cases be consolidated into one case.

The city is asking Superior Court Judge James Warren to declare unconstitutional two sections of the California Family Code that define marriage as a union between a man and a woman.

City officials want the judge to determine if restricting same-sex couples from marrying violates the equal protection and due process clauses of the California Constitution.

On Tuesday, Warren gave the city the choice of ending the same-sex wedding march or returning to court in late March to show why the process has not been halted. The city said it would continue issuing such licenses until forced to stop.

Well, looks like Prop 22 is about to go the way of Prop 187. Because the Leftists can't get their way at the ballot box, they once again use the courts as their personal special interest trump card.

But at the heart of it all, I'm left with just one burning question: Why isn't Governor Schwarzenegger upholding state LAW in this matter??

Now they are going to use CITY funds to sue the state for something that only a small percentage of the the residents want. San Francisco is singing the budget woes, and yet they spend money on this. This suit should be brought by private parties, not the city.

They are. But you mean through the legislature? Naw, why go to so much trouble when you own the judiciary of your state. Heck, Judges there can't even be supportive the Boy Scouts because it might prejudice them against the queers. No question which side will win. And all the legislators can wash their hands of it. It's pretty handy. I just wonder why the legislators are still receiving paychecks now that the judiciary has taken over their job.

My question - can a married couple, consisting of a man and woman, obtain 'gay' status - along with all the perks of having gay rights? If not, there maybe discrimination - no?

So nice to see that SF has so much extra money left over after paying its bills that it can afford to file lawsuits against the state.

The mayor and all other officials involved should be thrown in jail over this.

Hmmmmm. A new liberal technique. Break the law, then sue the authority who passed it.


Can we do this with anti-gun laws??

They should burn San Francisco (St. Francis must be turning in his grave) to the ground, fumigate the site, then start all over again.
