Palm Beach State Attorney’s Office Dances Atop Their SUV, Releases Confidential Correspondence

Roy Black Comments on the State's Release of Confidential Correspondence

Miami, FL – January 23, 2004 – Roy Black, attorney for Rush Limbaugh, issued the following statement today regarding confidential correspondence that was released to the media by Palm Beach State Attorney Barry Krischer.

“My letter to Mr. Krischer regarding Mr. Limbaugh’s case asked that Mr. Limbaugh be afforded the treatment anyone else would receive. The State's response was preposterous, but consistent with their double standard in this case. The facts are: Mr. Limbaugh went to these doctors to relieve chronic, intractable pain; there was no doctor shopping. Mr. Limbaugh never considered accepting the State’s ludicrous offer. He was not going to plea to something he did not do. We sent them a letter suggesting Mr. Limbaugh be treated in a similar manner that others had been treated. They responded with a preposterous offer. Discussions ended at that time. At no time was there ever a plea agreement of any kind.

"What the records don’t show is that before we could draft a letter responding to the State, we received a phone call from a newspaper reporter, as a result of a leak by the State Attorney’s office, asking us whether Mr. Limbaugh had agreed to enter a plea. As I told the court last month, we think the State Attorney’s Office should be investigated for journalist shopping.

"What is most troubling here is the continued violations of Florida law and bar ethics by the State Attorney’s Office. One need look no further than the bold caption on top of my letter alerting everyone to the confidential nature of the communication. The disclosure of these highly confidential communications violates the Florida statutes, the rules of procedure and evidence, and the Florida Bar Rules governing professional conduct. Because the State has no case against Mr. Limbaugh they continually seek to discredit him in the media.”

Actually, by my own logic, I don't have to ASK for a deal; I'm guilty of nothing.

Guilty of nothing, so I suppose you can be the first to throw stones at Limbaugh.

Ironically you followed the above statement by ASKing me to Read the letters on The Smoking Gun.

Why are you ASKing me for something. What are you guilty of now?

No, it's not new. I know Rush talked about transmission problems for awhile, though I wasn't buying that at the time. I don't think he has denture probs--thank God, anyway, that would be the least! of his problems. Actually, I think he's overly generous. I think that's the root cause of his problem. V's wife.

Do you think using narcotics that have been illegally obtained, whether from a doctor or his maid, is perfectly okay?

Provide evidence (hint: not stories sold to tabloids for hefty sums) that Rush illegally obtained narcotics.

I am sourcing the documents on Smoking Gun. If they are false I would presume that Limbaugh or one of his representatives would have challenged the data.

Re post 244, I too listened in today and heard nothing of the distortions of last Friday.

I earlier didn't mean to suggest that he had dentures; it was just a way of trying to explain how the distortions came across to me.

Actually, I'm thinking the rule of law is not equally applied to begin with.

Moreover, I was not writing about people playing golf and committing a "a felony by illegally procurring and taking controlled narcotics, provided (a) he's a famous conservative; and (b) he's taking the illegal drugs so that he can play freaking golf a couple times a week. Makes freak'in sense to me...The rules of society don't apply as long as you play golf."

Now you aren't making any freak'in sense to me. I wasn't even suggesting such a thing. I only stated that some guys and gals play golf not matter what kind of pain they are in...Geesh, have you got an over active imagination.

Anyway, I enjoy your posts and comments.

I know you were (and that's alright). I just wanted to take your remark and expand on it.

It's easy to forget that this is a full blown cultural war and some conservatives/Republicans don't want to believe it. There's nothing American about the leftist POV and they're dead serious about destroying what America was founded to protect.

If there is one thing I have learned about the judicial system in Florida, from the election of 2000, from the Terri Schiavo case and now this, it's that they don't let a little thing like the law and the Constitution get in the way of doing whatever it is they want to do.
