Palm Beach State Attorney’s Office Dances Atop Their SUV, Releases Confidential Correspondence

Roy Black Comments on the State's Release of Confidential Correspondence

Miami, FL – January 23, 2004 – Roy Black, attorney for Rush Limbaugh, issued the following statement today regarding confidential correspondence that was released to the media by Palm Beach State Attorney Barry Krischer.

“My letter to Mr. Krischer regarding Mr. Limbaugh’s case asked that Mr. Limbaugh be afforded the treatment anyone else would receive. The State's response was preposterous, but consistent with their double standard in this case. The facts are: Mr. Limbaugh went to these doctors to relieve chronic, intractable pain; there was no doctor shopping. Mr. Limbaugh never considered accepting the State’s ludicrous offer. He was not going to plea to something he did not do. We sent them a letter suggesting Mr. Limbaugh be treated in a similar manner that others had been treated. They responded with a preposterous offer. Discussions ended at that time. At no time was there ever a plea agreement of any kind.

"What the records don’t show is that before we could draft a letter responding to the State, we received a phone call from a newspaper reporter, as a result of a leak by the State Attorney’s office, asking us whether Mr. Limbaugh had agreed to enter a plea. As I told the court last month, we think the State Attorney’s Office should be investigated for journalist shopping.

"What is most troubling here is the continued violations of Florida law and bar ethics by the State Attorney’s Office. One need look no further than the bold caption on top of my letter alerting everyone to the confidential nature of the communication. The disclosure of these highly confidential communications violates the Florida statutes, the rules of procedure and evidence, and the Florida Bar Rules governing professional conduct. Because the State has no case against Mr. Limbaugh they continually seek to discredit him in the media.”

The Fed and the states certainly disagree, but quite frankly it is none of their damn business what people might choose to put into their own bodies or how much. It is not the Fed's business what is sold inside of states, and arguably it is none of the state's business what trade occurs between adults not dealing in stolen property. If you want smaller government and a government focused on it's legitimate role, then I suggest we get government out of the drug war. Then maybe it could focus on solving violent crimes and keeping violent criminals locked up. If the Fed had not been so busy being drug warriors, they might actually have been focused on terrorism enough to have had a better shot at preventing 911.

The War on Drugs is a proven failure. There is absolutely no evidence that it affects drug use in America at all. The only demonstrable effect of the War on Drugs is to raise the price of the drugs. Addicts become critically ill without their drugs. If they cannot afford to buy them on their conventional wage scale, they are forced to turn to crime to fund the costs of their addiction. The War on Drugs turns addicts into criminals, turns law enforcers ranging from the cop on the beat to jailers to judges into criminals. It has the potential to lead to the corruption of public officials at the highest level of public office. And there is not a shred of credible evidence of any positive benefit to a single member of society.

The drug court program results is a guaranteed dropping of the charges, there is every incentive to get into that particular program. It is also a very good program.

The media is not bothering to get all information on the story. It is as if they are only getting one source for the story. Like bahgdad Bob is writing for CNN.

I do have a "shred". Sorry I did not think of it. Defendants who go through the drug court system who would not get treatment but for the threat of criminal prosecution. It may be a small shread, but it is a shred.

I don't think the scandnavian example is worthy of emulation.

Did you ever doubt for one moment that Baghdad Bob was working for CNN......has been for years and years. That goes for MSNBC for the most part too.

Lately some of his opinions have even been showing up at FNC.

Finally! Black is doing exactly what (ahem) I would do. By leaking all that prejudicial information, the DA has made a fair trial in Florida impossible. The matter against Limbaugh should be dropped and the Governor should initiate an investigation of the DA's office by his AG rfn. Moreover, Black should file a federal civil rights suit against the county.

So the still unverified immunity was given, and the SA office waited almost a year in the hopes that Rush would admit to something that he still has not admitted to yet... (buying drugs illegally from the clines )

... remember, the doctor-shoppping buying took place AFTER the Clines were no longer a source...

Naw... don't think that theory works....

I believe Howlin is angry with Rush for being critical of Pres. Bush's domestic agenda. Anyone who says anything negative about Dubyah winds up on Howlin's $#!T list.

Hence, he wants to see Rush prosecuted.

I think it's as simple as that, sorry to say.

You are still fixated on the uncorroberated illegal purchasing of drugs. The SA has nothing to confirm illegal puchase of perscription drugs.

SOP would be to set up a sting to have the user buy the drugs illegally in a contolled situation. A situation with wire taps and video survelance. So far nothing, the have nothing to support illigal purchases from the clines.

This SA is politicall active. They needed the admission of adiction to put in their warrant as an element (motive), they needed the story to use the inevitable letters supporting prosecution to "be pressured".

Would the SA cultivate an investigation for months? ABSOLULY.

You are mistaken about the occurance of the "potential" doctor shopping, Rush was seeing those doctors long before Ed SHOHAT came to represent the Clines. With the medical records, the SA can "structure" a doctor shopping case going back years.

The doctor shopping law was passed as a means of stopping dealers from stockpiling drugs for later resale. Not for people use the drugs themselves.

The Clines did receive deal in their own dealing situation for "substantial assistance" in giving evidence for the pharmacy sting operation.

That would explain things.

Its too bad too. Rush converted me, and thousands of other like me from fuzzy headed liberals to conservatives. And he was doing it long before anyone even knew who W was, and he will keep doing it long after W has gone. I'd say outside of Ronald Reagan, no single person has done more for the cause of conservatism than Rush.

As far as him denouncing Bush's dropping the conservative ball, Its exactly what he should do. I wouldn't want him to become some republican party organ. He is, and should be, an advocate for conservatism. And when republicans stray from the path of conservatism they SHOULD be taken to task for it.

Exactly ... ( gee I'd like to leaf through the rest of Roy Black's "things I can do and blame on the prosecutor" files some day...) ... Do you think Roy keeps them next to that girls medical records he obtained by fraud and released to the media ?

Geez, the files were obtained as validly as a information in the SA's Rush Subpoenas. If they were obtained illegally, Roy would have been sanctioned. If they were obtained illegally were is the civil suit? Bar Complaint?
They were not obtained illegally.

How about the media going to court and overturning the Identity shield law for rape victims?

Perhaps this could be a lesson in Pre-trial publicity. Perhaps all pre-filing activity by defense and prosecution should be confidential until filing of charges or the declining of charges.

No matter the result, there will be a new left wing industry of "Rush in a mob boss" to justify why Rush was not brought up on Rico charges.

Re your post 112, on Friday, just before the show was over, I thought I heard a distinct garbling of Rush's initial words (as though he wore dentures and they had become loose), followed by clearer enunciation. This happened twice and both times while he was on the phone with someone whose speech was clear, so it was not station transmission problems.

After that they played two promo songs, something I had never heard before.

Is this problem new? Or had I merely missed it before?

No offence, but when you keep using Subpoenas you are confusing the issue.
The medical records were obtained using Search Warrents.

they were search warrents based on probable cause not subpoenas. It should have been subpoenas. my bad.
