High court rejects claim flag is religious [MS]

JACKSON - The U.S. Supreme Court on Monday rejected a claim that the Mississippi flag contains a Christian symbol that represents state endorsement of a particular religion.

John Ellis Briggs, a Muslim who sought punitive damages of up to $77.77 million and a ruling to ban the flag from public display, was appealing lower court dismissals of his claim the flag's Confederate battle symbol included the St. Andrew's Cross.

Briggs filed suit in federal court in Gulfport in 2001. A federal judge dismissed the lawsuit in 2002. Briggs appealed to the 5th U.S. Circuit Court of Appeals in New Orleans, which ruled against him in June.

The 5th Circuit said it could not accept that "every X, or every X the straight-line connection of whose four points would form a square, is predominantly a religious symbol."

On Monday, the high court refused without comment to hear the appeal.

Since 1894, Mississippi's flag has contained the Confederate battle emblem, a blue X with 13 whites stars over a field of red. Experts differ on whether the X in the Confederate battle emblem is the St. Andrew's Cross.

David Sansing, professor emeritus of history at the University of Mississippi, said recently that what people have claimed for years is the St. Andrew's Cross is not.

"What is in the Confederate battle flag is a blue saltier. The St. Andrew's Cross is a white diagonal cross on a blue field," Sansing said. "The man who designed the (Confederate battle) flag makes no reference to the St. Andrew's Cross."

Sansing said the St. Andrew's Cross dates back to the Middle Ages and represents the X-shaped cross on which the apostle Andrew was crucified. Andrew was the patron saint of Scotland and the St. Andrew's Cross is Scotland's national flag.

Now that's a new and different method of attacking the Battle Flag. Wonder when the ACLU types will pick up on this angle.

If they changed the constitution to allow government endorsement of religion look at all the ACLU and Supreme court justices that would be able to go into retirement. There is just WAAAYYYY too much knee jerk suits on this topic. Despite all the accusations of government endorsement of religion no one can point to a religion that has been formed through such endorsement! </I>
And furthermore, I challenge them to show me where in the constitution it says "endorsement". The constitution says "Establishment". This is just another shifting and bogus modification by the left of our constitution through repeated argument. Say a lie often enough...

Glad to see that recent congressional reprimand to the USSC for using European law as precedent for American legal rulings is having the right ripple effect.

Yeah, the server has been messing up for me too. Lots of "Internal Server Error" messages.

As for a comment on this thread. I'm surprised. The SC got one right for once. Then again, all it means is there were not four Justices dumb enough to grant Cert.

If the Court of Appeals had allowed the flag to be considered religious just because the guy "saw" a cross, that would make an outhouse an Islamic temple because of the crescent window on the door.

The 9th Circus has shown that they're immune to sanity and the letter of the law, so I'm sure they'll be immune to a tide of proper legal precedents. The only way you'll ever have good law come out of there is when the lot of them croak and real judges are appointed to fill the empty seats.
