Terri Schiavo update: Judge Baird's is OFF case.

This is a Hospice Patients Alliance Special Update Jan 5, 2004, sent out periodically to inform the public about news affecting hospice and end-of-life care.

We have just confirmed that ALL of Judge Baird's cases, INCLUDING the suit by Michael Schiavo v Gov Bush related to the Terri's Law, challenging its constitutionality, HAVE been transferred to Judge Nelly Khouzam. This information came directly from Judge Khouzam's assistant. Judge Khouzam is known to be a "by the book" tough, but fair judge.

The court is NOT explaining why the judges were suddenly switched, except to say that "judges rotate from time to time." We believe it might have something to do with:

Local PINELLAS COUNTY COURT BAILIFFS AND COURT EMPLOYEES WERE TAKING BETS ON WHETHER TERRI WOULD DIE OR NOT!!!

It was widely reported that Judge Baird made reckless and prejudicial comments in support of Greer and Felos and against Jeb's lawyers way before he had heard the evidence from the Governor's attorneys.

In other words, Judge Baird's comments are the likely reason local Pinellas County employees were doing "inside betting" that the local Pinellas County Judges would back each other's poor and constitutionally illegal decisions against Terri's constitutional rights and thus overrule Jeb Bush and Terri's Law. The 6th Circuit Judges are upset to have anyone tell them they are morally and legally wrong...... whether it's constitutionally illegal or not to murder Terri.

Conducting inside betting on the case is a severe violation of the code of conduct for court employees! Whether that is, or is not, the reason the judges have been switched, the very important change in judge can be extremely significant to what happens to Terri. We are hoping that Judge Khouzam will give the Gov a fair hearing in the case and allow the discovery he sought (which was denied by Baird). If Judge Khouzam allows some discovery as requested by Gov Bush, it could make all the difference!

I agree with you: my prayers are for Terri and her life, the only thing that matters. How those prayers might be answered will unfold with time, which means I'm learning patience!

One of the “fractures” alleged was of the right knee. During Terri’s original hospital stay this right knee became immobile and was examined thoroughly by the hospital staff. A radiological exam was performed and it was determined that there was no fracture and the bone morphology was normal. This is detailed in the hospital record.

You seem to have some information that I personally have had difficulty in getting hold of. Could you please point me in the right direction as to where you were able to obtain copies of the hospital record that confirms what you said? If you can verify this, it would go a long way in improving your credibility with some.

What makes you think that a judge appointed by liberal Lawton Chiles will rule in favor of poor Terri?

It appears that Judge Khouzam's credentials are excellent, and she's a minority and a woman. That may have been enough to satisfy the liberal Chiles. Remember that she was appointed in the days before the Senate began fillabustering judicial nominees.

These are the possibilities I see. I could be totally wrong, and something totally different could happen that we can't conceive. I don't claim to have a special pipeline to the Almighty. :o)

But at the same time, I understand where you're coming from. There are Freepers and others who have followed Terri's story for a much longer time period than I have, and have witnessed much more corruption than I have, in real time.

It's really difficult to hope against hope, and to fight evil, over a multi-year period. It's exhausting, and draining, especially when a life hangs in the balance. When the stakes are this high, the positive options seem to be pretty near to running out, and evil seems to be slamming every door shut, it's a natural thing to try and figure out if the odds are tilting to the positive. To answer the question, "Is there a basis in reality to hope?" To gain the necessary strength to forge onward.

I have seen miracles happen, and times when they didn't. I can't claim any knowledge how Terri's fight will turn out. All we can do is fight, pray, and trust God that He'll provide a ram in the bush; that He will, as the Rev. Martin Luther King once said, "make a way out of no way."

Lately, when I've turned to prayer about Terri, I have included all of you, my fellow Freepers, who have been "fighting the good fight," so long and so hard.

Governor Bush has a right to Trial by Jury which Judge Baird hasn't ruled on yet. Why? BECAUSE THEN JEB COULD INVESTIGATE ALL THE CHARLATAN JUDGES AND LAW ENFORCEMENT bureaucrats who golf and go to ball games together.

Some good news for a change. Thank You God. It looks like the new judge is fair too. That's what is needed here. We have only heard one side of this case (the pro-death side) for so long. Time to hear both sides now. Keep Praying for Terri.

I am still unsure if Baird has relinquished Terri's case to the female judge. One post seemed to indicate that Baird was retaining Terri's case, while having all others under his past jurisdiction transferred.

Hopefully this will allow to Terri to live and not have to meet the swallow test - swallows she lives - doesn't she's starved. That is SOOOO barbaric! It sounds so third world.

Sometimes it is more telling in what the Suspect didn't do as opposed to what he has allegedly done. In short, non-action may speak louder in terms of state of mind or possible motives.

With respect to the bone scan, MS has lots to explain what he didn't do ..... let's pull back and look at the big picture instead of being confined to technical details.

The bone scan was discovered in 1991, just a little over a year after Terri's initial collapse. Well, MS still very much needed Terri to get the big money at that time. Now, if he had nothing to do with the bone injuries, wouldn't you think he would scream bloody murder or gross negligence and start another lawsuit to go after another big pile of money?

The very fact that not only MS didn't go after the phantom assailant causing Terri's broken femur etc on top of hiding the fact about the injuries tell us a great deal about him and his state of mind. His non-action in this regard alone points to culpability because he will definitely sue if someone else made a boo-boo.

Let's not forget that while MS was playing the loving husband and hunky-dorey with the Schindlers between 1990 and 1993 just to get the big money from the so called malpractice lawsuit clearly shows his hidden agenda which we now know.

Bear in mind the original civil trial jury saw no red-flag on MS trying to kill his wife as it is evident today, but just the opposite, looking at him as a hard luck case, so in all probability the Deep-Pocket theory was their focus instead of possible criminal behavior of the husband. Therefore your assertion that there was a jury who dealt with this bone injury business is absurd.

In addition, and more seriously, did MS and his lawyers on the malpractice suit also hide this bone scan report during that trial? It seems funny that the Schindlers never knew about this bone scan business while following this trial back then. If so, why hide this info instead of letting the original civil jury to decide? Their verdict may well have been very different if they knew about the broken femur etc.

If you have info that this bone scan was indeed presented to the original civil jury D-D, then I'll challenge you to bring forth this information to us now. By default, if you fall silent, I'd take it that this is not the case, which validates the Schindlers' statement that this never came out and therefore possible criminal aspect was never considered in the first place.

Then the question goes back to WHY the bone scan did not come out, hence a criminal investigation should proceed now.

daylate-dollarshort: That issue was put to rest by the decision of the appellate court who found that there was no "foul" and supported their decision with the relevent case law. That decision could be appealed to the Florida Supreme Court, however it isn't likely that it will be accepted.

cyn: IOW, Terri's fight is up against an unbelievable enemy who fights dirty and to the death.

daylate, I know you're being accurate here, but so is cyn. It's always possible to find a justification under the law without serving justice, especially when the courts are stacked in favor of an agenda.

I've read many of the briefs filed on behalf of Terri, and many posts on FR, which quote law and precedence, and build a strong case in her favor. Since prejudiced judges are the ones who are calling the shots, it is the pro Terri arguments that are being flushed down the toilet, citations and all.

Under the law, justice is being miscarried, because the ones calling the shots "fight dirty and to the death."

Two thousand years ago, there were those who had asked if it was right to pay the tax. Their question purposely set up God's law vs. that of man, in order to set a trap for Jesus. They were quite surprised, to put it mildly, when they found out there was another option. "Render under Caesar" never occured to them. I'm hoping that these corrupt judges will end up being every bit as surprised, and as totally foiled, under the law, and by the same Person.

I find it very odd that just now, when people are finally starting to see how far the conspiracy to kill Terri goes…that the miraculous “daylate” shows up and launches an all out de-bunkathon against Terri’s supporters on Free Republic.

Things must be really heating up for you bad guys now that the truth is finally bubbling to the surface.

Your wasting your time here. None of us are impressed by your “I know all about the courts” mumbo jumbo. For all we know you are a member in good standing of the George Felos corn flake club. Or maybe your side is getting a little desperate and your just trying to pump Terri’s supporters for information?

Whatever your agenda, it is wasted on Terri’s fighter’s. Their eyes are wide open, and they won’t be lulled by the incessant drone of legal gibberish

You spoke boldly of the lack of evidence in Terri's case….so boldly that you must have an insider’s understanding of the fact that ANY an ALL evidence that could have ever help Terri has been blocked from being presented by the "Crack Pot" judges league.

You are trying awfully hard to rip Terri’s case. Its almost like your worried that Terri will be allowed to live...

Almost like you know something good is about to happen for Terri and you just can't stand it...

Terri has a bodyguard around the clock so that even her parents, etc. don't sneak anything into the room - cameras, recorders, flowers.

Well, as long as he/she keeps her loving husband from injecting her with insulin etc. it's probably a good thing, despite the insult directed at her family. I hadn't heard about this, so I thank you.

And thanks for your comments, which I find very informative and insightful. We pray for her and that teacher who lost her job standing up for Terri every night.

I guess we should expand that to the judges and all working behind the scenes.

I am saying my prayers too. Lets not forget that it was a different judge Crockett Farnell that helped us a bit. We do need to stop,remember and say thankful prayers for the few who have helped in Terri's case
