This is a Hospice Patients Alliance Special Update Jan 5, 2004, sent out periodically to inform the public about news affecting hospice and end-of-life care.
We have just confirmed that ALL of Judge Baird's cases, INCLUDING the suit by Michael Schiavo v Gov Bush related to the Terri's Law, challenging its constitutionality, HAVE been transferred to Judge Nelly Khouzam. This information came directly from Judge Khouzam's assistant. Judge Khouzam is known to be a "by the book" tough, but fair judge.

The court is NOT explaining why the judges were suddenly switched, except to say that "judges rotate from time to time." We believe it might have something to do with:
Local PINELLAS COUNTY COURT BAILIFFS AND COURT EMPLOYEES WERE TAKING BETS ON WHETHER TERRI WOULD DIE OR NOT!!!
It was widely reported that Judge Baird made reckless and prejudicial comments in support of Greer and Felos and against Jeb's lawyers way before he had heard the evidence from the Governor's attorneys.
In other words, Judge Baird's comments are the likely reason local Pinellas County employees were doing "inside betting" that the local Pinellas County Judges would back each other's poor and constitutionally illegal decisions against Terri's constitutional rights and thus overrule Jeb Bush and Terri's Law. The 6th Circuit Judges are upset to have anyone tell them they are morally and legally wrong...... whether it's constitutionally illegal or not to murder Terri.
Conducting inside betting on the case is a severe violation of the code of conduct for court employees! Whether that is, or is not, the reason the judges have been switched, the very important change in judge can be extremely significant to what happens to Terri. We are hoping that Judge Khouzam will give the Gov a fair hearing in the case and allow the discovery he sought (which was denied by Baird). If Judge Khouzam allows some discovery as requested by Gov Bush, it could make all the difference!

Also, Baird should be investigated. He is far too frantic to be involved in this case -- more than likely he has vested interest in it that prevents him from being objective.
No, I'm not saying statistics are evidence of a crime. The facts support my belief that Terri's interests are better protected by her family - her own flesh and blood, than by her husband, who is statistically more likely to injure her or cause her death than any other population group.
The circumstances surrounding Terri's mysterious 'collapse' have never been fully explained, the court records from the malpractive trial were sealed and Terri's parents found out only last year that she had a number of broken bones, signs of trauma and according to at least one doctor, her neck injuries were consistent with strangulation, NOT bulemia or a 'heart attack.'

MS was never properly investigated nor were the circumstances of Terri's initial 'collapse'. A sworn affidavit which details allegations of Terri being injected with insulin by MS was ignored by Greer. THAT is why this case is a travesty and Baird and Greer have proven they are totally incompetent to judge it! And it's no surprise that rumors of Judge Khouzam replacing Baird have Felos and HINO quaking in their designer loafers.
As to him remembering years later that she wanted to die -- come on, who can believe that? Even if she did say it, she might not have meant it or changed her mind. There is no living will, thus the word of someone with an agenda is no proof.
In suspicious death, the police routinely investigate the spouse first. That this was no done in Terri's case shows at best sloppy police work.
Dr. Hammesfahr evaluated Terri and gave testimony on his conclusions during the 2002 trial. He stated that not only is PVS an incorrect assessment of Terri's condition, but also that she can be greatly improved with new therapies. Dr. Hammesfahr specializes in a number of successful therapies and has offered to treat Terri, citing that she is an excellent candidate for rehabilitation.
Dr. William Hammesfahr was nominated for the Nobel Prize in Medicine and Physiology in 1999 and has been called "the first physician to treat patients successfully to restore deficits caused by stroke" by Judge Susan Kirkland of the Florida Department of Health. His patient success rate is an amazing 80%.

Exactly! And I learned just last week that the two St. Petersburg police officers called to the scene of Terri's collapse noted to route their report to 'homicide.' MS hired an attorney within days - possibly expecting criminal charges to be filed. On Larry King Live, he refused to allow access to Terri and refused to take a lie detector test to prove his credibility.

That's when I started thinking about all the other aspects of Terri's situation that are equally unbelievable -- even though they have unfolded before our eyes! Such as the fact that Jeb signing Terri's law did not effect an immediate relief and release for Terri from her death sentence. I'm gonna say that again:

To the contrary. Terris collapse has indeed been determined by a jury, who heard all relevant testimony and reviewed all of the evidence. That jury determined that the cause of Terris collapse was cardiac arrest precipitated by a severely low potassium level. Further, this same jury found that the low potassium level was caused by bulimia nervosa and that Terris doctors should have discovered that bulimia during their treatment and found that their failure to do so was malpractice. They also found that Terris practice of bulimia contributed to seventy percent of the cause of her death and the malpractice award was reduced by that percentage.
Dr. Hammesfahr did indeed state that that in his opinion that the stiffness of Terris neck, as reported in the medical record, were consistent with strangulation. What he failed to state, though he knew full well, was Terris stiffness was global and involved her entire body. The hospital report notes this stiffness and also documents that Terri was suffering violent convulsions and seizures and further, that there was great difficulty controlling them. Is it any mystery why her neck might be described as stiff?
The medical record never states that Terri suffered a heart attack. To the contrary it states that she didnt suffer a heart attack. It is clearly stated that she suffered a cardiac arrest. There is a difference. This notion that Terri never suffered a heart attack in order to support allegations of some allegation that she was attacked and/or murdered by her husband is more than disingenuous. It is a red-herring intended to mislead the public.
Was Terri strangled? Was she worked over real good resulting numerous broken bones being as has been stated here? The best evidence says no. The paramedics that responded to the Schiavo residence the morning of Terris collapse did not see any indication of physical injury. They did find her in cardiac arrest.
The police officer who also responded to the Schiavo residence, found absolutely no evidence of any disturbance or anything that would indicate a physical altercation or struggle. This experienced officer also went to the hospital and noted that there were no bruises or any other indication that a strangulation or beating had occurred. He makes a notation that there is "no mid-line shift" that would indicate a physical insult to Terris brain.
The emergency room staff similarly makes no observation of any physical injury and further, there is no indication that physical injuries are mentioned or observed by the ICU staff.
Additionally, Terris brother was on the collapse scene and made no reported observation of any visible injuries. Neither did her parents though they were present at the hospital and observed her.
Miraculous! All this violence, all of these injuries and not a bruise, red mark or any other indicator of injury. Miraculous!!

The State Attorney, Bernie McCabe, has been attacked viciously on these threads. It has been demanded that he bring charges against Michael Schiavo, convene a grand jury or institute an investigation into the abuses allegedly committed by Schiavo. He has responded [b]ring me some evidence. A simple and reasonable enough request. However, to date, no one has.
One of the fractures alleged was of the right knee. During Terris original hospital stay this right knee became immobile and was examined thoroughly by the hospital staff. A radiological exam was performed and it was determined that there was no fracture and the bone morphology was normal. This is detailed in the hospital record.
Despite the allegation that there was never a proper investigation, the Florida Department of Law Enforcement did look into Terris infamous bone scan. They took the scan and report to more than a few doctors for their opinion. All reported that in their opinion, the accumulation of calcium detected by the scan was a result of osteoporosis. Brittle Bone Disease. Why do you think the doctor who made the report of this scan didn't report his findings to some authority?
Finally, as to the insulin allegation, it was just that, an unsubstantiated allegation. The nurse making these allegations was found to have no credibility after a hearing involving this and other statements. Several other nurses and aides testified and directly refuted her testimony. None of her claims were substantiated by facts or testimony by others who participated in Terris care.
I see, all of the judges- (more than 15), all of the treating physicians, nurses, technicians and others- (what, maybe a conservative 75 or more?) and the Appellate Courts. And let's not forget the two independent guardians appointed in this case. Are all part of a conspiracy to protect Michael Schiavo and kill Terri Schiavo?
