You know, I didn't think we had a chance in the 8th District even with all of Moran's problems (the district is so liberal that Bush was held to just 37.6% in 2000), but after seeing Melissa Martin, I think we can win this thing. Bush will probably get over 40% in the district in 2004, meaning that Martin needs to get an extra 10% to win. Between Moran's anti-Semitism and Martin's looks, we've got at least 5% in the bag; if she can keep up with Moran's spending, she'd have a shot of getting the additional 5% she needs to win.

But I will tell you, I can't remember the last time someone in my state was convicted of manslaughter for this. I don't know what state you live in, but a manslaughter conviction doesn't even make the news in Texas.
It's not a murder charge. It means you did something so stupid that killed someone that you should be charged with a criminal offense. Usually the penalty isn't terribly high.
If your state doesn't prosecute manslaughter charges, then you live in a lawless state.

Amen and Halleluiah! I hope Governor Rounds takes his sweet time before setting a date for the special election (although unfortunately I don't belive he'll be able to wait until November of next year).

Also, if you serve probation, doesn't that mean you have been found guilty of a crime?
And, could those cases be plea agreements... the perpetrator plead guilty to the crime?

A lawyer's view of reality:
"My client didn't have enough to eat."
"My client had too much to eat."
"My client didn't eat the right foods."
"My client didn't get enough sleep."
"My client had a bad day."
A layman's view of reality:
"Your client was speeding, driving recklessly, ran a stop sign, and killed the guy he collided with."

Another story says he will resign 20 January.
Who chooses the next SD representative? Governor? Is the governor a RAT or GOPper?

The GOP can run practically any statewide officeholder and win this seat.
No, waiting in the wings is the young Democrat that Janklow defeated in 2002 -- Stephanie Herseth, granddaughter, I believe, of a former SD governor. The House seat is likely to change party hands in SD.

What about fat Teddy?

Good. My post 45 was just pessimism in action.

No special treatment for politicians of any stripe.Normally I try to read the entire thread before I post, but I agree with you on most other things and I agree with you now.

We have learned from the Terri Schiavo case that an "appeal" won't help Janklow -- necessarily. The original trial finding will stand. The appeal can be based only on procedural errors by the prosecutor. Even if new evidence turns up now, it cannot be used in the appeal.
I guess Janklow found out that he WAS not as popular in SD as EMK IS in MA.
To: ican'tbelieveit
Yes. I think pleas are the answer to light sentences.
However, I think he has a case for an appeal. (but I'm not a lawyer)

The fact that Fat Teddy got off is no reason to let anyone else off in the country. Massachussetts is an aberration in too many ways already.
The jurors in South Dakota did the right thing, and if we start excusing people for bad behavior that wasn't punished in the past, we might as well let people slit throats everywhere, just because OJ did and got away with it.
