Governor Seeks New Trial Over Brain Damaged Woman's Wishes

Gov. Jeb Bush fired a volley of legal shots Wednesday at the husband of a brain damaged woman who is at the center of a right to die case, saying there needs to be a jury trial on whether Terri Schiavo wanted to be kept alive artificially. The governor also sought to remove Pinellas Circuit Court Judge W. Douglas Baird from hearing the constitutionality of the new law enacted to keep Terri Schiavo alive after her feeding tube was removed last month. In yet a third legal filing, the governor argues that Terri Schiavo's rights under the Florida Constitution are being protected, not violated.

Terri Schiavo went for six days without food and water after her husband Michael Schiavo removed her feeding tube. Florida lawmakers and Bush intervened, enacting a hastily drawn law that allowed the governor to order the feeding tube be reinserted.

Michael Schiavo has challenging the constitutionality of the governor's action. He contends his wife had said she did not want to be kept alive artificially before she suffered severe brain damage in 1990. Doctors have ruled she has been in a persistent vegetative state since, but her parents believe she is aware of her surroundings and could be rehabilitated.

Bush's attorney Ken Connor said a jury has to establish what Terri Schiavo's wishes were before a court can decide whether her private health care wishes were violated.

George Felos, Michael Schiavo's attorney, could not immediately be reached for comment.

In a society steeped in moral relativism, "murder" is too harsh a word to handle.

You are sooooo right. Call it something else and make it more acceptable. After all, who in their right mind would agree that it is a woman's right to murder her baby? But, it's a woman't right to abort a fetus! The deed is no different, but changing 2 little words makes it acceptable.

God help Terri. Someone has got to get her out of that hospice and out from under Michael's guardianship.

Since Roe v. Wade. And they made THAT a privacy issue as well. I guess where we're headed is that murder of certain people is just fine as long as it is done in private and the murderer is in some kind of relationship of authority over the victim. "But you honor, my wife wanted me to murder her. She was asking for it."

Yeah well, we all have our share of corruption in our churches, not to mention those crazy aunts and ex-con uncles who insist on coming to the supper table. After all, the Baptists have Bill Clinton and Judge Greer. I am (or was) Episcoplian, and I don't have to tell you the absolute humiliation and apostasy we're facing right now. It comes down to this: true believers can be found in any church that preaches Christ crucified and resurrected, but Satan spends a lot of time in church winning converts too, so before the members of one Christian church go judging the members of another, they should look in their own closets and follow the directive of Jesus, "let he who is without sin cast the first stone."

I would think the biggest thing going against MS is that he waited an awful long time to 'remember' that Terri had said she would not not want to be kept alive.

Gooooood point. Seems to me a great many people who are afraid of Michael, took their time reporting something favorable towards Terri, and this sham of a 'court' said: 'sorry, you waited too long'

And yes, that's the thing of it, you've got to represent your intended victim as either less than human, or evil, or both. Otherwise, people will be people and will resist violations of moral law towards each other. Once you get them to hate -- then they are slaves and you can get them to commit the most heinous offenses. Once they hate, they will build Auschwitz.

To say "Terri's a turnip," or "in a PVS," or any such formulation is preparation for doing evil.

If she is nonresponsive (and frankly after what she went through with the six days of being dehydrated and starved, I'd be surprised if she's more responsive than she was before)--or "vegetative," there is no reasonable explanation for sedating her--period.

Since you are well versed in legal matters, I have a question. George Felos is perforce an officer of the court, is he not? You can say many things about Felos, but "stupid" is not one of them. I am certain that he knows his client is guilty of attempted murder. He has filed several motions specifically to cover it up (cremation, blocking the bone scan). He also knows that MS is lying about Terri's "wish" not to live that way. He's covered that up too, by twisting words. He knows further that Terri's condition does not fit the Florida definition of PVS required for killing a patient, but he has deliberately exaggerated her injury, ignored his client's cruel neglect of her and downplayed her chances of recovery. (He even helped himself to most of HER therapy money.)

It's ethical for an attorney to represent a man he knows to be guilty of a crime, of course. But it seems to me a different matter altogether for the lawyer to HIDE a crime (attempted murder) from the court, and to misrepresent plain facts in order, in effect, to FINISH the murder. That's going a long way past representing a scoundrel. That's being a knowing accessory to the crime.

She is being visited regularly now by the GAL and possibly others. Could be they want to make sure she isn't responsive or, as someone else suggested, it could be that they want to get her addicted enough to create withdrawals were the meds stopped before administering tests to keep her behaviors from appearing deliberate or consistent. I don't know. Just guessing. See also #202.
