I was watching Oprah with my daughter, and have told her very little about this case. "He did it." That was her reaction. She thinks he is lying. I will explain more about the malpractice suit and the potassium reading which was the basis for the settlement. In other words, if he really did do it, that lawsuit (1) probably couldn't have gone forward without looking into it more, and (2) if he did do it, that lawsuit was a smokescreen and he would be liable to repay all the money and other negative consequences.

I hadn't told her about some of the doctors speculating on possible strangulation and the bone scan.

Which is why the frenetic hustle to mow down Terri's Law as quickly as possible. They want to moot the guardianship challenge, which technically does have legs

Does anyone know how close the guardianship challenge is to being heard???

Oprah did a good job with the story. She showed quite a lot of Terri's videos and gave Terri's family a chance to tell us a little about Terri.

I believe this is the applicable right we are speaking of. The so-called right to privacy could only be based here. Furthermore, I believe we actually agree that this amendment has been bastardized by the courts in cases of abortion and hastened death, etc. While creating new rights, our real rights are being taken away with impunity. Sheesh.

I think it's very important to any appeal of Greer's ruling that Greer found hearsay evidence "clear and convincing." It would not be so in a Death Penalty case - which goes to Terri's right to due process. It's also a violation of her right to due process that the feeding tube was not considered "artificial life support" at the time she made that casual remark - yet Greer found that her expressed wish to die if disabled included being on a feeding tube. The circumstances in the Quinlan case, her respirator/ventilator, were not the same as the circumstances of Terri's present physical needs, either. So there are many violations of Terri's rights that would be sufficient for a new trial if this was a criminal case.

"Lone Voice in the hinterlands" checked for us. Evidently Judge Greer decided not to schedule a hearing, hoping it will go away when the contitutional issue is decided.

Overall, I thought she did, too, and the family did well. They seemed to exercise restraint from throwing out very much negative, vindictive stuff. I wish Oprah would have given them more time and asked some of the harder questions.

One face. Without decent Judges making decent judgements we will have violence in every aspect of of (shortened) lifes. That Judge -- Greer -- what a terrible, vile ruling, a "finding of fact", he made!

Thankfully Terri's family are in there seeking redress for her unstateable-by-herself grievances.

Respecting even an obviously errant "husband's" privacy does not mean ignoring the clear and public suspicions that there is a conspiracy to murder going on. Again, thankfully, her parents and siblings advocate on her behalf, making what appears might be a "private" murder, public.

What I'd like to know, is where this "presumptively" came from. This is a legal term, this is not a mere pejorative. Not even the droolingest ghouls on this board have ever argued that Terri's Law is "presumptively" unconstitutional without a trial on its merits. Felos is only Beelzebub. Baird is Satan

Look, I have no more than a pre-school education when it comes to the Law, but permit me to ask a stupid question .....can this "verdict without a trial" be contested now in any way by the Bush Attorneys? Please explain .....

I would think at this point it has to be evident to Jeb and gang what a struggle it has been for the Shindlers. They are now seeing first hand the difficulties that these judges are dishing out against Terri's family. You think that they would be a little laid back when messin' with the 'gov'. What the h*** is going on here? They have Felos on the local news now saying that Jeb should back off the fight after hearing the remarks of the judge.

I think most people with common sense and a heart can see that Terri responds with some awareness and MS is a Mega-Creep.

I think that segment was very much in Terri's favor. Wish they would have showed the video where she opens her eyes real wide when asked to do so.

A strong objection to the Bill of Rights was that by containing an enumeration of rights, it would: (1) eventually protect only those rights and any the non-enumerated right -- ALL of which are reserved to the people -- would be at risk and degraded. And (2) by being a enumeration it implied that individual rights are an enumerable. They are not.

It is the authority we allowed our Federal Goverment in that charter, the Constitution, which is enumerated, and limited to those powers that we then enumerated and later added to.

That was the argument that Washington and Hamilton gave in opposing a Bill of Rights. But Madison, "the father of the Constitution" won the day. RI and NC said that they would not join the union without a Bill of Rights.

The Oprah Winfrey segment on Terri was very brief. The Schindlers said little about Michael R. Schiavo, for they know that he will take away their visitation if they speak too frankly. I think that the whole unreal situation is holding them back -- fear that their visitation will again be taken from them. They did the best they could with the little time given. I suspect that few in the Oprah viewership would be motivated to send emails, letters, or calls to the powers that be, based on this very brief segment.
