Winners and Losers in the Terri Schindler Affair

Assuming that Terri pulls out of the dehydration, and Ted Koppel seemed unsure Tuesday night that she would, here is my long list of "Winners" and "Losers" in this fight for life and death:

WINNERS:

1. The Almighty God -- Without Him we could do nothing. He came through when all doors had seemingly been shut and even locked. "To God Be the Glory, Great Things He Has Done."

2. Governor Bush -- Though he seemed very slow-acting, it was his relentless efforts primarily that brought about another chance for Terri to survive and hopefully gain needed therapy

3. Terri herself -- Who could have surived 155+ hours without water and food? Certainly not I or most people. She is incredibly strong and has a great will to live.

4. The Schindler family -- They never gave up when every red light stopped them. They lost their home to fight for Terri. They were never bitter and kept the faith to the end.

5. House Speaker Johnnie Byrd -- His courage in getting "Terri's bill" through the House in swift speed should sit well with Republican primary voters considering his candidacy next year for the U.S. Senate

6. Senate President Jim King -- He could have thwarted Terri's recovery, and at first he appeared hostile to the bill. Yet he decided to reverse his position because a life hanged in the balance.

7. Randall Terry -- He took over the hospice vigil and spoke for the family when other well-known right-to-life figures were unavailable. He did an excellent job. He never made his own leadership a part of this fight. Despite his past personal failings, he performed well.

8. Larry Klayman -- He filed a brief arguing that Bush could have intervened, and then he pulled out of the fight, not wanting those who would use his involvment to undermine the fight for Terri.

9. Daniel Webster -- This state senator with a famous name, not well known outside FL, proved one of the most effective voices for the voiceless.

10. Grass-roots organizers -- While the starvation/dehydration seemed a "done deal," the grass roots never stopped calling, faxing, and emailing. They scored a real victory, though the courts could make it short-lived. If Terri survives to tell her story, this fight could nearly match the success of Phyllis Schlafly's fight against the "Equal Rights Amendment."

11. Dr. James Dobson -- The television psychologist came to bat for saving Terri's life at the last minute with effective TV and radio presentations. He argued what Thomas Paine had argued in 1776 -- common sense and plain arguments.

12. Michael Schiavo's mother -- She died before Michael got the first order to remove the feeding tube. She never lived to see her son dishonor his name.

THE LOSERS:

1. Michael Schiavo -- Now he will have to beg Meredith Viera to let him appear on "Who Wants to Be a Millionaire" if he aims for quick millionaire status. He has replaced O.J. Simpson and Scott Peterson as the "guiltiest-looking" man in America.

2. George W. Greer -- He could now well be defeated for judge next year in Pinellas/Pasco counties. People will forever question his judgment, wisdom, honor, and decency. He is the poster-boy of the runaway power-mad judiciary. Defeat in 2004 is too good for him.

3. George J. Felos -- The "right-to-die" lawyer has been unmasked as a weird buffoon. Why would a client procure him now? Who would buy the book that he may still write?

4. Lawton Chiles -- Though in his grave, it was Governor Chiles who appointed runaway judges like Greer and those on the FL Supreme Court, who are still likely to weigh in on this case. The trouble with these FL judges is by no means a part of the past.

5. Schiavo's future mother-in-law -- Not even known by her name, this woman took over the death watch and ordered Mrs. Schindler around as Terri lay dying. She is the dictionary picture of "nerve." What a shameful human being.

6. Schaivo's finacee -- She may need now to recheck her status with her lover. He may be so out of his mind now that he has lost interest in her.

7. The innocent Schiavo children -- Their father has so dishonored their name that they may want to bear the mother's maiden name in the future.

8. FL judiciary -- It cannot be stressed enough how George W. Greer has dishonored the liberal judiciary in FL. The state needs to reform its judge-selection procedures. The "yes" or "no" plebiscite format in FL is proving insufficient to keep undesirables off the bench. Perhaps states considering this format, such as TX, might reconsider adopting this plan.

9. The hospice movement and particularly Suncoast Hospice-- Most people probably had a favorable impression of hospices and their role in caring for the dying. The Schiavo case though may cause us to reevaluate this movement. Who would have suspected corruption in this institution?

10. Organ donations -- This affair could cause people to withdraw agreements or refuse to make commitments to donate organs. People may so fear that the medical establishment would terminate their lives just to harvest their organs.

11. Senator Robert Graham -- While Terri lay dying, he said not a word though he is like all Democrat senators a defender of the "disabled." Instead he spent the week wondering if the 2004 Democrat presidential nominee might choose him as the vice-presidential selection. In contrast to Graham, Governor Bush was a strong leader in this fight.

12. (Last but not least) Peter, Tom, Dan, Katie, and all. They never even figured out that Terri was not "comatose." They missed out on one of the great stories of the decade, as they instead reported about missed weapons of mass destruction, the CIA "leak," and Kobe Bryant. Why would anyone get his news from these four?

Good list, I appreciate seeing it stated so clearly. The very clear and detailed statement by Terri's father in response to the petulant screed of the frustrated, cheating husband, enhances the positive standing of the father and further diminishes all of the losers.

But I do have a question. Does Florida have a provision for recall of a judge? While I agree that 2004 is the best opportunity to dispose of this monster, sooner would be even better.

But I do have a question. Does Florida have a provision for recall of a judge? While I agree that 2004 is the best opportunity to dispose of this monster, sooner would be even better.

I have heard that FL has no recall for any officials, but I don't know for sure. Were it possible to recall George W. Greer, he would probably play the role as martyr and victim to the hilt.

Great! However, this morning on one of the big news cable networks (not FOX), they were still calling her a vegetable and BOTH spokesmouths (experts) were still criticizing the governor, etc. yada yada yada. Then someone stated that Terri's organs may have suffered damage. This nightmare just won't end.

FIRST OF ALL, IT IS POSSIBLE THAT GEORGE GREER IS NOT LEGALLY A JUDGE:

"...112.52 Removal of a public official when a method is not otherwise provided.--

(1) When a method for removal from office is not otherwise provided by the State Constitution or by law, the Governor may by executive order suspend from office an elected or appointed public official, by whatever title known, who is indicted or informed against for commission of any felony, or for any misdemeanor arising directly out of his or her official conduct or duties, and may fill the office by appointment for the period of suspension, not to extend beyond the term.

(2) During the period of the suspension, the public official shall not perform any official act, duty, or function or receive any pay, allowance, emolument, or privilege of office.

(3) If convicted, the public official may be removed from office by executive order of the Governor. For the purpose of this section, any person who pleads guilty or nolo contendere or who is found guilty shall be deemed to have been convicted, notwithstanding the suspension of sentence or the withholding of adjudication.

817.505 Patient brokering prohibited; exceptions; penalties.--

(1) It is unlawful for any person, including any health care provider or health care facility, to:

(a) Offer or pay any commission, bonus, rebate, kickback, or bribe, directly or indirectly, in cash or in kind, or engage in any split-fee arrangement, in any form whatsoever, to induce the referral of patients or patronage from a health care provider or health care facility;

(b) Solicit or receive any commission, bonus, rebate, kickback, or bribe, directly or indirectly, in cash or in kind, or engage in any split-fee arrangement, in any form whatsoever, in return for referring patients or patronage to a health care provider or health care facility; or

(c) Aid, abet, advise, or otherwise participate in the conduct prohibited under paragraph (a) or paragraph (b).

(2) For the purposes of this section, the term:

(a) "Health care provider or health care facility" means any person or entity licensed, certified, or registered with the Agency for Health Care Administration; any person or entity that has contracted with the Agency for Health Care Administration to provide goods or services to Medicaid recipients as provided under s. 409.907; a county health department established under part I of chapter 154; any community service provider contracting with the Department of Children and Family Services to furnish alcohol, drug abuse, or mental health services under part IV of chapter 394; any substance abuse service provider licensed under chapter 397; or any federally supported primary care program such as a migrant or community health center authorized under ss. 329 and 330 of the United States Public Health Services Act.

798.01 Living in open adultery.

798.02 Lewd and lascivious behavior.

798.01 Living in open adultery.--Whoever lives in an open state of adultery shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. Where either of the parties living in an open state of adultery is married, both parties so living shall be deemed to be guilty of the offense provided for in this section.

tutstar, I needed a window, so this one had to go. I started these thoughts a few days ago, and I am not finished. I also posted more info along these lines on two threads yesterday, regarding the possible crimes being committed here. I'm posting it here now, although I was not finished with it, because I'm afraid my computer may crash, and this much would be lost. With so much information spread out all over the place, it would be hard to reconstruct, and wasting time I could better spend elsewhere.

Interesting, but I'm skeptical that any action would be taken. After all, who would make that decision....a court? In Florida? Not likely. Now if he was a conservative, that might be a different story.

Excellent, TR! Could you add to the 'loser list' the pro-death culture - and industries and individuals seeking to profit from the untimely death of their neighbors.

Terri's case woke up a few of those neighbors.

Thanks for the kind comment, Ragtime Cowgirl, but I was premature. I wrote that "Winners and Losers" vanity Wednesday while Terri was still in the hospital. I had no idea Schiavo would take her out Wednesday night. I thought that Bush was her temporary guardian and could order spoon feeding, etc. I am much less optimistic than I was Wednesday noon.

The FL Supreme Court is anti-Bush, both George W. and Jeb. It will definitely strike down this law or any other law intended to save Terri. This court is entirely political. It won't even read the law except to get a few lines to refute.

I honestly now believe that the only way to save Terri is for the federal police to abscond with her and take her to another state, where the Schindlers can petition for guardianship. I don't think she can survive in FL. But we saw a great miracle Tuesday night -- almost not but a miracle nevertheless.

A judge can be impeached in Florida as far as I know. Impeach Greer yesterday!!
