I CALLED JEB'S OFFICE. THE LADY SAID THE BILL HAS PASSED AND THAT THE GOVERNOR WAS GOING TO SIGN IT.

And if the court declares the legislation unconstitutional?

And if the court declares the legislation unconstitutional? It's a risk worth taking.

But we still have this problem:
George Felos, a lawyer for Michael Schiavo, asked a judge to stop Bush even before he received the bill. A hearing was scheduled for Tuesday afternoon

Fla. passes bill allowing feeding tube By JACKIE HALLIFAX The Associated Press 10/21/2003, 4:12 p.m. ET TALLAHASSEE, Fla. (AP) Lawmakers sent Gov. Jeb Bush a bill Tuesday that will give him the power to order a feeding tube reinserted into a brain-damaged woman at the center of one of the nation's longest and most bitter right-to-die battles. Bush said he will immediately sign the bill and order the tube to be reinserted into Terri Schiavo. The woman's parents, Bob and Mary Schindler, want her to live. Her husband, Michael Schiavo, says she would rather die.

I'm not a Florida attorney, but the argument would probably be made on separation of powers grounds.
It's the same principle where the Texas Supreme Court refused to order the runaway Democrat legislators back for redistricting.

I don't think a judge can stop him from signing legislation sent to him.
To: Cool Guy
Now WHEN DOES THE TUBE GET INSERTED and Terri start receiving hydration and nutrition.? It surely better be immediate.

I think that's why they part about the "family member dispute" is in there.
I believe that the family was discounted and the spouse given too much power. This should change the nature of things entirely.
If this all fails however, shiavo should be forced to return every cent left of the money he sued to get for her "life long care".

Great news - thank you Gov. Bush and the Florida legislature.

Bush need to send the State Police immediately to Terri's care facility. He also needs to send a special physician to oversee her treatment. The State Police need to guard Terri 24 hour a day and 7 days a week. Next -- Bush needs to get a Catholic Priest to her bed side. Never too late for miracles.
At once! Yesterday! Last week already!
Perhaps it is already too F'n late. I'm so disappointed with Jeb Bush I could just scream.

I don't understand why the Governor should have the power to make decisions on these cases.
Granted, the law is a mess in this area, but granting the Governor dictatorial power over families, doctors and patients is a cure that's worse than the disease.
