The Washington, D.C., watchdog group Judicial Watch filed an abuse complaint it says will allow Florida Gov. Jeb Bush to intervene on behalf of Terri Schindler-Schiavo, the brain-disabled woman who is starving under a court order initiated by her husband.
Judicial Watch President Thomas Fitton faxed a "Form to Report Abuse/Abandonment/Neglect/Exploitation" with the Florida Department of Children and Families yesterday then sent a letter to Bush and DCF Secretary Jerry Regier.
The letter said, "Based on our formal complaint via the faxed report referenced above, you have the authority and sufficient cause to immediately order the Florida Department of Children and Family Services to intervene on behalf of Ms. Schiavo; to restore her nutrition; and to initiate a full investigation of the circumstances surrounding Ms. Schiavos disability."
Fitton said these actions are in accord with the U.S. Constitution, the Florida Constitution, Article 2, Section 5, and Florida statutes 825.102 and 782.04(2)(i), 77.04.
The abuse report, under "Description of Incident," says:
Thirteen years ago Terri Schiavo suffered brain damage from a sudden collapse. She receives her food and water by means of a feeding tube. Terri's other bodily functions are stable. She responds to voices, and is capable of smiling, laughing and crying. She vocalizes well.
Terri's husband, Michael Schiavo, has denied her any rehabilitation treatment since 1993. On Wednesday, October 1, 2003, Michael Schiavo directed that Terri's feeding tube be disconnected, subjecting her to starvation and dehydration that will result in an anguishing death in approximately 10 to 14 days.
Judicial Watch is known for its many lawsuits against President Clinton's administration. But the group, led by Larry Klayman, also has taken on the current White House, including a lawsuit to force the release of information about Vice President Dick Cheney's energy task force.
Klayman recently declared he will run for a U.S. Senate seat from Florida.
Legal documents and information on Terri's case are posted on the family's website.

My immediate reaction is that I am less than pleased that Klayman has intervened. But I'll gladly hold my nose if it helps save Terri.

I'm very suspicious of this because it could have been filed much earlier: either Oct. 1 when the order was made, or at 2:30 p.m. on Oct. 15 after the feeding tube got disconnected.
If this weren't the Terri Schiavo case, I'd be really ticked off at Klayman. I'll hold my fire for the moment in hopes that what he's doing accomplishes something.

My problem with this is the fact that the surest way to lose is to get Klayman involved.

My problem with this is the fact that the surest way to lose is to get Klayman involved. Maybe more specifically "You know a case is hopeless the minute Klayman gets involved." That's a chilling thought-rooting for an exception.

Well, this is good enough for me to go to bed now at least.
Whew. Thanks for finding that.

LARRY KLAYMAN (R) resigned from Judicial Watch 3 weeks ago.
LARRY KLAYMAN (R) is now running to replace Florida's U.S. Senator BOB GRAHAM (D).

Wish I could feel confident that it means something beyond the usual JW grandstanding.

Then what's going on? I'll guess we'll find out more in the morning.

I agree completely. Any port in a storm.
If this gives Jeb the fig leaf he needs to take action, I will take it and be grateful.

Why do I not have a good feeling about Klayman running for Senate as an R? My immediate reaction is that there must be better Pubbies out there (Katherine Harris, perhaps?), and that he has more baggage than a fully booked 767 overseas flight.
BUT ENOUGH, I want to know if what JW is doing means anything.

TOM FITTON now runs Judicial Watch as its President and should have one hell of a lot to say about this case during tomorrow's Weekend...

I don't care if Godzilla saves her, but somebody do it!
I read in another post that a family member of Terri's saw Michael Schiavo at the mall today.
The gall of the man. Shopping, eating, drinking, walking around while his wife is being tortured to death.
There are special places in hell reserved for the likes of him.
To: litany_of_lies
Now I'm REALLY worried. Klayman's success rate isn't too inspiring. I hope, really hope, that he can finally win one - especially in this case...
If Klayman and Judicial Watch can pull this off successfully, I will never EVER say another bad word about them.

That strikes to the heart of my frustration about this:
WHY IS ALL THIS HAPPENING ON A FREAKING FRIDAY, WHEN IT'S MOST LIKE THAT NO RESULTS CAN OCCUR UNTIL MONDAY (DAY 5, VERY, VERY LATE FOR TERRI)?
Talk about potential Pyrrhic victories......
To: litany_of_lies
Katherine Harris just got in the House in January. She is seeking reelection. She should stay where she is.
To: deannadurbin
a family member of Terri's saw Michael Schiavo at the mall today
So then Schiavo is not in disguise. Is he still staying away from his house?
To: litany_of_lies
Good luck. I hope it works.
