FREEPERS, I have taken a break from Terri's 24/7 Vigil to ask for your participation in the next phase of trying to save Terri's life while we wait for good news.

I have not received the Governor's Itinerary for the following week yet from myflorida.com.

We are asking Floridians and out-of-staters to freep the Governor's Mansion in Tallahassee.

If you need ideas for signs, it's basically urging Governor Bush to issue an executive order to stay Terri's starvation.

At this time, the Florida Supremes are reviewing filings today by Terri's counsel.

We need northern Florida to freep Jeb Bush STAT whether he's there or not.

Finally, if anyone receives Jeb's schedule in their e-newsletter, please post it here so we can hold Terri vigils in whatever town Jeb is in.

You mean like Judge Greer?

Basically, what's needed is for the three branches of government to be willing to bitch-slap each other when appropriate. And Judge Greer deserves a firm one.

One thing which might help some future cases like this from arising would be for the governor to have the authority to compel a particular judge to recuse himself from a case and have a procedure by which judicial findings of fact could legitimately be challenged before another judge. There would have to be strong standards of proof involved in any such challenge, but such challenges should not be so effectively forbidden as they are now. As it is, getting a judicial finding of fact overturned effectively requires that the judge overturning the finding of fact be able to do so while accepting that original judge's interpretation of all applicable evidence.

For example (and this is a slight exaggeration, but not by much), suppose Terri had danced a jig in front of Judge Greer, but Felos called Doctor Nick Riviera to testify that such dancing was "merely reflex" and that Terri was in fact vegetative, and Greer declared that he found Doctor Nick's claim credible and Terri was, in fact vegetative. Even if the appellate court saw Terri dancing a jig, the fact that Judge Greer found Doctor Nick's testimony credible meant they would have to as well.

If Terri were to dance a waltz instead of a jig before the appellate court, then that might be grounds for appeal. However, the Schiavos would have to demonstrate that she wouldn't have been able to do the waltz before the original trial court. Even if the Schiavos did demonstrate that, they wouldn't gain much because the most likely result would be to have the case remanded to [guess who] Judge Greer, who would then declare credible Dr. Nick's testimony that Waltzing is all based on reflex just like dancing a jig.

Who's supposed to have more power--the governor, or a trial-court judge? Unless Bush does something, it will be clear who does have more power.

Like many another, had I known of this earlier, I could have convinced the Schindlers that the legal system does not always deliver what is morally correct and just. I'd be dead myself if I'd had only the law to protect me.

The game was fixed before the Schiavos even walked into Greer's courtroom for the first custody hearing. Had they been able to recognize that, they might have been able to do things differently. But I can't blame them for their naiveté. Indeed, until I started reading about this case I hadn't realized quite the full extent the evil powers of corrupt trial court judges; I understood some of the pieces, but hadn't realized how they all fit together.

I have a personal hunch that the reason Terri has had such a strong will to survive is because she wanted to see the Schiavo Triumvirate face justice. I hope that even if the Triumvirate do succeed in killing her, her 13-year struggle will prove not to have been in vain. Any thoughts on how Act III should play out in the unfortunate event that Act II of Terri's saga ends before the crooks face justice?

I see no reason to expect good news. Though I'll admit that the way the judicial system is set up an appeals court would have to go way outside accepted practice to do anything useful in this case; since the SCOFLA is famous for going way outside accepted practice, they could if they wanted to do something useful.

But I sincerely doubt they will.

825.102 Abuse, aggravated abuse, and neglect of an elderly person or disabled adult; penalties.--

(1) "Abuse of an elderly person or disabled adult" means:

(a) Intentional infliction of physical or psychological injury upon an elderly person or disabled adult;

(b) An intentional act that could reasonably be expected to result in physical or psychological injury to an elderly person or disabled adult; or

(c) Active encouragement of any person to commit an act that results or could reasonably be expected to result in physical or psychological injury to an elderly person or disabled adult.

A person who knowingly or willfully abuses an elderly person or disabled adult without causing great bodily harm, permanent disability, or permanent disfigurement to the elderly person or disabled adult commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(2) "Aggravated abuse of an elderly person or disabled adult" occurs when a person:

(a) Commits aggravated battery on an elderly person or disabled adult;

(b) Willfully tortures, maliciously punishes, or willfully and unlawfully cages, an elderly person or disabled adult; or

(c) Knowingly or willfully abuses an elderly person or disabled adult and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the elderly person or disabled adult.

A person who commits aggravated abuse of an elderly person or disabled adult commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(3)(a) "Neglect of an elderly person or disabled adult" means:

1. A caregiver's failure or omission to provide an elderly person or disabled adult with the care, supervision, and services necessary to maintain the elderly person's or disabled adult's physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine, and medical services that a prudent person would consider essential for the well-being of the elderly person or disabled adult; or

2. A caregiver's failure to make a reasonable effort to protect an elderly person or disabled adult from abuse, neglect, or exploitation by another person.

Neglect of an elderly person or disabled adult may be based on repeated conduct or on a single incident or omission that results in, or could reasonably be expected to result in, serious physical or psychological injury, or a substantial risk of death, to an elderly person or disabled adult.

(b) A person who willfully or by culpable negligence neglects an elderly person or disabled adult and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the elderly person or disabled adult commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(c) A person who willfully or by culpable negligence neglects an elderly person or disabled adult without causing great bodily harm, permanent disability, or permanent disfigurement to the elderly person or disabled adult commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Don't man made "rules" sound utterly stupid?? No wonder we all need a Saviour. Judge Greer, Michael Schiavo and his family and the doctors who have "cooperated" and the Attorney Felos, are ALL ruled by demonic spirits. And the Governor and President Bush have just lost my respect. We cannot talk out of both sides of our mouths. Either were pro-life or pro-death. No in between. I am really disappointed with what I have seen here. Govenor Bush has had emails from all over the world. He's had several from here. And obviously even from the UK. Disgusting!!

Are you literate? The caregivers have a positive legal duty to feed this women. Their obediance to an order of a court that requires them to let her die in no way vitiates their duty nor the Governor's duty to enforce the law. The judge has ordered a criminal act, that is ultra vires and therefore null and void. Try reading the statute again. Get help if you cannot understand it.
