TERRI’S FIGHT TO LIVE – DAY 3 CRUEL AND UNUSUAL PUNISHMENT

According to a memorandum submitted by Dr. Kevorkian’s prosecuting attorney, Jack Thompson, Esq., “The U.S. Department of Agriculture in its own regulations at 9CFR2.131 prohibits the withholding of food and water from farm animals. Terri Schiavo is not less than a farm animal.”

Thompson continued, “If you, as Governor, were to order the execution of a serial killer on death row by means of withholding food and water, you would be ordered by any number of courts not to do so. The horror of dying by dehydration makes death by electric chair, by comparison, an act of compassion . . .” “You have the power and the duty, under both the Florida and United States Constitutions, which you took an oath to uphold, to enter an Executive Order, today, to prohibit the imposition of any cruel and unusual punishment in this State. Upon entering such an Order, you then have the power, right and duty to give force to that order by dispatching state law enforcement officials to take custody of Terri Schiavo and stop her forced starvation and dehydration.”

Please continue your calls to Florida Governor Jeb Bush 850-488-4441 to ask him to do the right and proper thing, to protect Terri’s God given right to life!

I called about an hour ago and was told that Jeb's legal team is aware of the legal opinions posted on the website.

I asked if my comments would be conveyed to the Governor and was assured that they would.

My basic argument was that JEB MUST ACT for moral & legal reasons. He is the only one who can save Terri and if he refuses to listen to the latest legal advice; he will be contributing to her 'judicial murder'.

I added that many voted for him because of his pro-life stance and that should he decide to run for the Senate or the Presidency....his lack of action would be remembered by pro-life voters.

FREEPERS: Our best hope of saving Terri is to keep calling JEB's office over & over again!

When and where did Jack Thompson prosecute Dr. Kevorkian?

From another thread on the case, I now understand your confusion. Jack Thompson did not prosecute Dr. Kevorkian. Richard Thompson, who is the lawyer for the Thomas More Center and submitted a brief to Governor Bush, prosecuted Kevorkian. Though Jack Thompson also submitted a brief, as longtime Freepers could tell you, he is an entirely different animal.

Until this case I had never heard of a civil court in the United States ever ordering a death sentence.

Is this the first time this has been done, or was it done in earlier euthanasia cases?

It sounds like the political, judicial, and legal system is in a state of utter disrepair to me.

Wait I do have an opinion on this one. This whole case has been one of emotions and of course it should. But there is a couple facts that has not been discredited.

1)According to the husband it was the wife's wishes to NEVER live in a vegetative state. Now before there are some in here to discredit this claim I know MANY, including myself that has this arrangement with my wife as well. I know the parents can say there were none but until that is prooven I would say respect the person's wishes.

2)The husband is not set to receive ANY insurance money as a result of his wife's death. Therefore he has no alterior motive to see her death through. At least these are my views on this matter.

There is evidence that the husband tried to kill her, which is the reason Terri is in the shape she is in today. His motive to withhold therapy from her, which as been the case, is to keep her from talking. His desire not to go to jail for the attempted murder of his wife is a POWERFUL motive for his current actions!

I really wonder if poor Terri will "matter" by the time of the next campaigns. I have seen few pro-life leaders involved in Terri's fight. Most pro-life leaders seem content to elect Republicans so long as the candidates wear the "R" label. I had already heard Jerry Falwell, for instance, "endorse" Jeb for 2008! I think the Bush operatives believe that Terri's fight will "blow over."

I really don't undersand why Jeb WON'T get involved. Is it really cowardice? Is he afraid the Republican House in Tallahassee would impeach him? If so, what good is a GOP House in FL? Is he afraid of federal charges being brought against him? Just what is his FEAR? He must be ashamed at his fear of acting -- it's like a paralysis of fear.

Can the GOP continue to walk all over its base and still keep winning elections? The party leadership seems to think so.

Why didn't the husband provide any rehabilitative care?
Why didn't he remember her so called 'wishes' when he was suing for the malpractice money?

He said he needed it to provide for her rehabilitation but has never done so. He clearly wants her dead so he can marry his pregnant paramour and not have to be concerned that Terri may one day implicate him as the cause of her disabled state.

Guess he's an EX-freeper then. Care to provide any more details? Does this wholly discredit him or just make him look a little wild?

No matter, the Thomas Moore Center briefs made a whole lot of sense to me.

Judge Greer has maintained that Michael Schiavo is a proper guardian for Terri. Michael Schiavo has been defrauding Terri for more than seven years, cohabiting with another woman with whom he's fathering children yet has not divorced Terri. Judge Greer has placed his stamp of approval/judicial command upon the right of Michael Schiavo to remain Terri's legal guardian and for Michael Schiavo to kill via dehydration the wife he has been defrauding for lo these many years, the wife from whom--with complete judicial complicity from Judge greer's secret ruling--Michael has stolen a trust fund designated for her rehabilitation therapy, a wife whose death will profit the defrauding 'guradian'/adulterous husband. IF THAT IS NOT A TRAVESTY OF FLORIDA JUSTICE WHICH THE GOVERNOR HAS RESPONSIBILITY TO ADDRESS AND SAVE THE WOMAN BEING DEFRAUDED IN HIS STATE, THEN B-U-S-H IS THE SPELLING OF A NEW PET ROCK, FOR ALL THE USE HE IS.

Interesting though, that Michael Schiavo testified at the malpractice trial that he loved his wife, wanted to take care of her for the rest of his life but just lacked the means. As a result of his testimony, Terri was awarded money to be placed in a medical trust, earmarked for her rehabilitative care. He never once mentioned anything about her wishes to be allowed to live or die.

As soon as the money was under his control, he placed a DNR on her chart. He then stripped her of even the most basic care, such as brushing her teeth.

The very first time he ever brought up what she supposedly said was a full decade after her accident when her parents tried to block his efforts to have her killed. He suddenly remembered that she had mentioned something about not wanting to live like that.

A little different from the agreement you have with your wife, no doubt.

Michael Schiavo was awarded $300,000 for loss of consortium. The balance of the $1.3 million award was designated to provide rehabilitation services for his wife.

Within months--not years--following the $1.3 million award, Michael petitioned for her death by suddenly recalling Terri's wishes. The timing is, errrr...suspect.

This has not been prooven and was mentioned on "The Shawn Hannity Show" by the father of said woman. Until this man has been PROOVEN in a court of law to have performed such action then this man is innocent of such allegations. Why has it taken 10 years for this to come out?
