I am a lawyer in Colorado, and I deal with wills, trusts, probate, end-of-life matters.

First, a living will is a very very limited document and is out-moded. the Medical Durable Health Care Power of Attorney is a far better and broader document to use.

Second, the absence of a "living will" does NOT say that you MUST rescusitate or keep a patient alive. Here in Colorado, for instance, if there is no LW or MDHCPA, then the immediate family gets to decide care when the patient is unable to do so.

It appears that Florida has a very similar system, and in the absence of the LW or MDCPA, the husband has the right to determine treatment when the wife is unable to make those decisions.

That's the LAW! And, leaving out this particular case, is a very good system, for it keeps the medical decisions where they belong--close to home.

What can Jeb Bush do? This is in the judicial system of Florida, right now.

To paraphrase Andrew Jackson, the Judicial Branch has made its decision, now let them enforce it. Jeb doesn't have to let them get away with murder; he can break the law and intervene if he feels like it. All he has to do is get her out of Florida, and the Florida courts won't even have any authority, right?

I still really hope that this can be stopped.

Yes, many people may lose because federal district judges are lost in extra-Constitutional space; and thank you.

I agree. It should be this way. It usually works fine. Families come together most of the time, even though one has the final say, and nothing is done unless they are all in agreement. I don't think we need any new laws but situations like this are horrible. I have to tell you that if it had been one of my son's, he would have been in Mexico 12 years ago, even if I went to jail. Where is the cushion for rare cases like these?

So do I, but I also like the idea that, in the absence of a medical directive by the patient, the immediate family gets to make the medical decisions when the patient is unable to do so. Although anything can be abused, this keeps decisions where they belong--close to home.

The cushion is supposed the right to petition the court for a redress of grievances. But no system is failsafe, and in this situation the courts have been involved all along.

But, I don't like situations like this where, in esssence, we are killing people. It bothers me tremendously.

The nice thing about the mom here (if anything nice can be said about losing your mom) is that the woman and her brother were able to be there with her to the end. The mom in the story had definately made a decision to end her life- as she spelled out on her board. Pain control measures were taken , to make her comfortable during her last days -though it was rough start, because of the laws exc... ( I can tell you that the subject of pain managment is a source of constant debate/controversy in the medical community)

The awful thing about Terri's case is that we don't know if she has made a decision to end her life , or, even if so- Did she want it ended in this manner?

She will not have family around her. The husband has ordered that police be placed in front of the door to her room because "he doesn't want family or friends anywhere near Terri"- so Terri's parents-brother and sister- will not be able to comfort their dying daughter/ sister during her last days. She will die alone- her own mother and father , brother and sister are not "ALLOWED" to be with her while she is dying

We don't do this to death row convicts- they are allowed to see their families- We don't starve/dehydrate as a means of execution either-it would be Cruel and Unusual punishment. Can someone please tell me what crime Terri has committed to deserve being treated worse than the most vile inmate on death row?

I seriously doubt that Terri will be given anything to ease her pain either, since her husband has been overheard to say "Why won't that b*tch just die?" These are not the words or actions of a man who is "concerned" about his wife's comfort.

The whole thing is a sickening joke. Judge Greer is an abomination.

I didn't watch any of this unfortunately. I'll say this much. If the Governor of FL does not step in and save this woman's life, then the bastard needs to be thrown out on his ear.

There's too much covering up in this case and far too many questions involved for anyone to agree to let this woman die. There are other options and somebody needs to exercise them.

From one dad to another tho, I would have to say to Terri's father, YOU have an option. You can put a stop to this and do it in a way that WILL get national attention.

Moral courage is something that is sadly lacking in this country and it's by god time for Men to stand up to the powers that be, violently if necessary to protect our loved ones.

Rebroadcast coming up around 2:10am est. After the piece about Terri, Bill Bennett comes on, and adds some sensible comments about giving Terri time.

MARMEMA WROTE: "I guess not...This site Says 3-10 days. Only a few of the past victims seem to have lived longer. Marcia and Tony were exceptions.."

My 82 year old Aunt (who had just had a massive stroke) had a living will to not have any means of support, including a feeding tube. She lasted TWENTY-ONE DAYS without food and virtually no water.

I kept trying to get my cousins to TRY SOMETHING to help her following her stroke---and which HAD helped after a smaller stroke---but they kept insisting that she "had a living will and didn't want any herculean (sp?) measures, e.g. a feeding tube." Of course, I never heard her say it nor did I have access to her "Living Will." She was also an Aunt by marriage, i.e. she married my Uncle (who preceeded her in death).

Having a daughter, however, who is severely mentally and physically disabled, and who neither walks nor talks and who used to have to have a feeding tube and respirator, I do NOT look at a feeding tube as "life support" per se.

Terri looked pretty good to me in the video shown on Hannity & Colmes tonight. From the info I read from Terri's brother (I think), it sounds to me like the husband probably STRANGLED HER, but failed to kill her and now he is just trying to cover his tracks to COLLECT A PILE OF MALPRACTICE MONEY and SELL A BOOK.

I guess one of the advantages of technology is that we are more likely to hear about these injustices. Now the question remains whether or not we will be able to do anything to change it. It always amazes me that people stay so ignorant. I take that back. When you consider that most people have to spend a full day working (both husband and wife) and then the rest of the day getting ready for the next day, it isn't really a surprise that most people don't have the time or energy to keep up with much of what is going on outside their sphere. As a result, they continue to support people who lie through their teeth about what they represent. Who was it who said the way to best destroy America is to create apathy in it's people. It's all very frustrating.

It got attention, but Sean still did not get the facts right. He said to the father, something about when she dies tommorrow, He does not seem to realize that Terri won't die tommorrow, she will die only after suffering extremely for a number of days. I really wish he had said that instead of the other thing.

Fine. If it's not about politics (which I never said), it does mean it will take someone breaking the law (which is what I was talking about) and going banana republic to save her. If that's the case, uno animo, round up your own band of merry man and go save her. Jeb has no more responsibility than you do if you're advocating going outside the legal system.
