Dems Reportedly Considering ‘Total War’ If GOP Fills Supreme Court Seat, Including Possible New States

Democrats are reportedly gearing up for “total war” and plan to implement radical changes to the legislative and judiciary branches of the government if the GOP-led Senate confirms a new Supreme Court (SCOTUS) justice before the Nov. 3 election then lose the majority after the election, Axios reported Sunday.

The Democrats’ options include ending the Senate filibuster rule — which requires a 60-vote supermajority to end debate and move to a vote instead of a simple majority — expanding the number of Supreme Court justices, granting statehood to the District of Columbia and Puerto Rico, and even undertaking a second impeachment effort against the President if he tries to fill the seat vacated by Justice Ruth Bader Ginsburg.

If they're going full nuke Armageddon on the country anyway, they'll first expand SCOTUS & install 6 new radical Millenial Marxists who guarantee they'll rubber stamp everything Pelosi & Schumer ask for.

Then Congress passes DC statehood in violation of the Constitution. GOP sues. The new SCOTUS majority will quickly locate never-before-seen Penumbras that prove that those other sections you mention don't really mean what they seem to say, and they will issue a ruling upholding DC statehood.

As easy as falling off a piece of cake.

Why, I'll bet many of us Freepers, or the Babylon Bee, etc, could come up with a list for starters.....

How about: "The Interstate Commerce Clause justifies this, just as it justifies every single other thing Congress wants to do, and it overrides everything else in the Constitution".

Or how about: "The only reason to deny DC statehood is animus & racism towards people of color, who form a super majority of DC residents. Therefore, various & sundry 'equal protection' clauses in the Constitution demand this".

(Anthony Kennedy was legendary for scrutinizing laws & detecting 'Animus' motivations behind them, when on multiple occasions he wrote 5-4 opinions striking down perfectly legitimate state laws that were non-PC on social issues).

So, doesn’t West Virginia set precedence that when portions of a state is so politically divided that the legislature cannot or will not grant the motion?


Doubt it. The bulk of the Virginia legislature voted to separate itself and VA from the Federal Government. Legislators from northwestern VA constituted a rump loyal legislature which the Feds recognized. It was this state legislature that agreed to West Virginia statehood.

Could VA, after the war attempted to challenge this? I suppose they could, but given the feelings after the war they would have no chance of winning the argument.

They have to have a majority vote in both the House and the Senate and not have a veto from the President to create a new state.

I think the idea is that a greatly reduced federal district would continue to exist including the area where the Capitol, the White House, and a number of important federal buildings are located, just north and south of the Mall. The very small number of people residing within that area would then be entitled to cast three electoral votes, while the new state (supposedly to be called New Columbia--but where is the old Columbia?) would have two senators, one representative and therefore three electoral votes. The whole idea is an outrage but if they have a majority in both houses next year and a Democrat in the White House they will probably go through with it.

The flag has had 50 stars since 1960--the longest period when the number of stars has remained the same. Their plans would mean a flag with 52 stars.

I do not see that the 23rd Amendment gives the district three electoral votes. I do see that it grants the number of electors equal to that of the smallest State...

Interesting scenario. If D.C. were to become a state and the President were to legally change his residence to what is left of the Federal District. His vote would grant 3 Electoral votes.

They just can’t wish away the 23rd Amendment, or I guess with their 6 extra Justices appointed by President Harris, maybe they can.
