Proving what you are suggesting (treason) is monstrously more difficult than proving that the use of her private server and the classified material found thereon is a violation of that particular section 18 USC so often cited. Frankly, I don’t think she committed treason in a legally provable sense. I know I will get pushback on that comment. There should not be the slightest question that multiple operatives have been exposed and very likely killed as a result of her stupid server tricks. But that is OK, losing a few people is nothing new for the Clintons.
Now....I certainly do not rule out the kabuki exercise of deliberately overcharging her such that a trial will take some number of years; thus kicking this whole criminality thing well down the road.
This is really an open and shut case if the charge(s) stay simple and oriented around 18 USC and nothing more. There are some 1200 of those violations, every one of them carrying serious jail time as the penalty. There’s no wiggle room. What she meant to do, what happened as a result, how she may have benefited, whether there was deliberation on her part; are all ephemeral. Those classified emails, their sheer presence on her server, is black and white proof of her “carelessness” and violation of 18 USC. That doesn’t mean she and Kendall will not try with every ounce of their being and millions of dollars in legal fees. No doubt she and Billbao will set up a “Hillary Defense Fund” and accept donations from those obligated to her for the 100:1 ROI payback deals she already granted them. In fact...setting up such a fund and dutifully transferring the donations to the Clinton Foundation thereto would be a brilliant tactic by the GOP, but “brilliance” and “GOP” are not possible to use in the same sentence.
