Donald Trump Says He May Ted Cruz to Disqualify Him: 'I Already Have a Lawyer'

Donald Trump says he's considering suing GOP rival Ted Cruz to challenge the Canada-born Texas senator's eligibility to be president.

"I'm thinking about it very seriously," the GOP front-runner told ABC News' George Stephanopoulos on Good Morning America Tuesday. "I already have a lawyer, we're looking at it very seriously, we're thinking about it."

Most Constitutional scholars agree that Cruz, who was born in Calgary to an American mother and a Canadian father, is eligible to run for president. But Trump has repeatedly questioned the senator's presidential qualifications under the Constitution's "natural-born citizen" clause.

"He was born in Canada," Trump said Tuesday. "Lawyers - many lawyers - are saying he doesn't even have the right to run for president. He can't be president because of the fact he was born in Canada, lived there for years. I mean, under that theory I guess Winston Churchill could be" president....

I’ve said the same thing on here many times and, up to this point, the standard response has been, “He [Trump] doesn’t have standing...” So which is it?

If Cruz is determined to be ineligible, so be it. But, although Trump has a brilliant legal mind, I’ll put my very fragile faith in the legal system ahead of my faith in “I’ll sue you” Trump.

Yeah, and Trump is “Mr. Principles” in the flesh. Give me a break. We all know that Trump is petty and cannot stand to be challenged. If Cruz weren’t a threat, Trump wouldn’t be fanning out his underwhelming plumage in order to try and scare Cruz away.

None of us wants the issue of eligibility or citizenship. Right now, the Dems are standing back and letting us duke it out regarding Cruz’ and Rubio’s eligibility. But we shouldn’t think for one minute that if one of them were to get the nomination, the Dems wouldn’t be on him like stink on a turd to take him and the RNC to court. We’d be tied up in court drama for months. I’ve heard they have the papers drawn up already just to pull out if needed.

If that happens, our side will not win! The lower courts are stacked with liberals. Then it would go as high as SCOTUS, like Bush v. Gore did. SCOTUS is not a complete body now so that would force us to let Obama push through his choice just so there would be a 9-judge panel.

God help us if Cruz or Rubio should prevail. It’ll be a hot mess in America for months and months.

Trump has a lawyer.... sheesh... I wonder if that will scare CRUZ??? Trump is all show. It’s a carnival... step right up and see the guy with the crazy hair... he has a lawyer too!

Of course, Trump has a lawyer. Hell, he has several all of whom are charging him thousands of dollars per hour to chase after his latest whim. As long as Trump pays the bills, he could find an attorney who would take the law of gravity to court.

And from what has been read at an earlier date - both parents were able to vote in Canadian elections.

Your reading comprehension needs work. The document that was posted showed a list of POTENTIAL voters - basically just a list of the residents of a certain area who MAY have been eligible to vote. It was the responsibility of the people who got the list to canvass the area and determine if the people on the list were a) eligible to vote and b) if so, registered to vote. Oh and by the way, that list was from 4 years AFTER Ted was born. So even if they had been eligible to vote in Canada at that time, it has no impact on whether or not Ted is a US citizen from birth.

Mac-do your homework before attempting to write about something you seem to know very little.

Seems like you need to follow your own advice...

There aren’t any. It’s interpretation and belief. I listen to Trump and come to the same conclusions Cruz does. A snake oil salesman puts out his pitch and you believe him or you don’t. With Trump, I don’t. Is that a lie? Nope, because it’s what I truly believe (along with Cruz and a bunch of other folks), right or wrong. Which is why I vote we go easy on each other. Each side (except for the paid trolls) is probably as sincere as it gets. There’s no value in us destroying each other. That only helps our common enemy.

(3) If he talks a lot about it but does nothing, which is where we are now. This puts the seed of doubt in voters minds about Cruz, but doesn’t actually lead to a resolution, which would play out as points (1) and (2).

But doesn't stalling on this issue and threatening a lawsuit that never comes undermine his supposed decisive, can-do nature? Trump is supposed to be a man of action but on this issue all he does is talk.

I’m wondering if this lawyer is the same lawyer he had “look into it” and said it was all fine. No problem. Different day, different position. All because Cruz had the temerity to rise in the polls and give him a run for his money.

Be careful what you wish for - if Trump sues Cruz for his constitutional ineligibility (i.e. Cruz is NOT a nbc), Cruz just might be disqualified from competing for the presidency!
Trump would be doing everyone a favor if he does -
1. Cruz will be declared eligible or not, freeing him to pursue his dream job, or not, freeing his supporters the fear/anxieties from Cruz’s own refusal to address this issue;
2. Trump would have done the jobs for the democRATS, who will have to disqualify Cruz if/when he is the nominee.
3. Trump would have done the jobs for the GOPe who want to remove Cruz, 1 of their ‘unloved’ contenders!
4. Trump would have done ‘We the People’ the greatest favor by clarifying what exactly a natural born citizen is, so we can wipe obama off the US history and eliminate all his policies and appointees..., and going forward, we can abide by the Constitution 100%, by allowing only the nbc to run for the presidency.
5. Trump would be the hero of all time for being the one and only influential person with ‘standing’, and the courage to address this issue once and for all, bringing an end to the huge fight on what nbc is.

However, bear in mind the court and Congress will NOT address this issue -
The Courts always hide behind ‘no jurisdiction’ or ‘no standing’ or ‘it is a political issue’ or delay forever till they can declare it ‘moot’....
Congress, well, will do its best to avoid this issue and pass it back to the courts....

Before the R nominee is named, the court will say the plaintiff has not sustained any ‘harm’ yet, so will not rule on the case,
After the nominee is named, the court will say it is too late, it is moot, you should have sued before he is nominated.....

Oops, I should not have revealed that Trump does not have much chance of winning in court on this issue, but I cannot lie.

If you yell that Trump should stop talking and just sue Cruz now, you are either smart enough to know Trump will not get the nbc term defined by the court despite all his efforts/time/money, OR deep down you wish Trump, your chosen candidate’s opponent, will do something to remove the uncertainties surrounding your candidate.

Cruz has a great case for being NBC. Jus sanguinis (right of blood) applies, even if jus soli is the dominant means. As for those who’ve studied the Constitution, what about these guys?

Section 101(a)(23) INA (8 U.S.C. 1101(a)(23)) provides that the term “naturalization” means “the conferring of nationality of a state upon a person after birth, by any means whatsoever.” Persons who acquire U.S. citizenship at birth by birth abroad to a U.S. citizen parent or parents who meet the applicable statutory transmission requirements are not considered citizens by naturalization.

That’s from the State Department”s Foreign Affairs Manual. They’re not binding legal authority, but they’re supposed to know, and they are no friend of Cruz.

So, here’s the question: if Cruz is not a citizen by naturalization, as the FAM quote suggests, what one other possibility remains?

Whereas your NBC definition comes from ... where? No citation? Your personal opinion? Are we still a nation of laws? Or are we becoming a nation of poorly supported personal opinions?
