She was a mental patient on the loose, a totally different situation than your premise.

A patient has a record of who took care of them and it could be narrowed down as to the responsibility of the rape in a hospital where sex would not be permitted.

OMG! Somebody on this thread is actually back to talking about what's relevant to the trial - not whether Rita is a liar or the accuser OD'd on sleeping pills!

As I've said repeatedly, this will all come down to the physical evidence. If it doesn't point to sexual assault, Kobe walks. If it does, Kobe may still walk because he's a superstar athlete. Or it may mean a long probation and he'll have to sweep the ski lifts in Vail next summer or sign autographs at the Eagle homeless shelter. I can't imagine they will actually send him to jail - he's a first-timer.

The accuser's credibiltiy is not going to be the determining factor in the case because the very fact that she had sex with a superstar athlete within the first two hours of meeting him automatically pegs her as a gold-digging thrill-seeker no matter what her past history is. She could have been a nun but, if you're screwing an NBA superstar, everyone assumes you are just a gold-digging groupie slut. She has no credibility without physical proof and that's what will win or lose this case.

All the testimony and gossip about who said what is just to deflect from what the real issue is - does the physical evidence prove rape?

Of course, if the jury consists of 12 women from NOW, all bets are off.

About Westerfield: I just heard the FBI profiler John Douglas say on the radio the other night that probably Westerfield had done something in his past before the little Van Dam girl. He just didn't get caught.

I know I read somewhere that there may have been some sex attacks in Kobe's past, but who knows where those rumors came from.

Ah. Then we're not in complete agreement. I haven't heard anything so far to make me question her credibility. And I don't see how she can avoid testifying -- she's the only eyewitness to the alleged crime. But based on what's been reported so far, I agree that the physical evidence is likely to be the deciding factor. If it is really as strong as has been reported, Bryant is likely to be convicted.

The 911's were accounted for and had nothing to do with domestic violence or attacks of any kind by Kobe. It was reported as such since the morning.
