Jury begins deliberations -Prosecutor says victim has pointed to her killer (keep it civil)

Jurors in the David Westerfield trial began deliberating yesterday after hearing a final statement from the lead prosecutor, who beamed a photo of 7-year-old Danielle van Dam onto the wall and urged the jury to focus on the physical evidence.

Finishing closing arguments in the two-month murder trial, prosecutor Jeff Dusek called a blood spot on Westerfield's jacket the "smoking gun." And Dusek imagined what Danielle might tell the jury if someone could bring her back to life "just for a moment" so she could answer the question, "Please tell us who did this to you."

"I've already told you," Dusek said the girl would tell the jury. "I've told you with my hair and where you found it. I've told you with the orange fiber that you found on my choker, and where you found it.

Red herring? You mean like the hair on the fence? Like the UNIDENTIFIED hair under her body? Like the UNIDENTIFIED prints on the points of entry/exit, bannister, door frame and dresser that Dozeoff says DON'T matter? Like the UNIDENTIFIED DNA on Danielle's blanket that Dozeoff says don't matter? Like the laundry list? Like the add? Like the rope the assine DA was playing with during the closing?

No, the dog was more than adequate as a watch dog, as shown the next day when LE and other well-wishers and strangers began to parade through he house. The dog went frantic and jumped on each one, until it had to be removed.

Whether the noise it made was quite a "bark," exactly, it had no trouble making its concern known.

Cyncooper, actually you're not exactly right about the drycleaners' computer/printer problem.

Julie Mills (1st clerk) testified that the reason the times were wrong on her receipts is because she may have entered them into the computer after DW left (printer problems). Kelly Belom (2nd clerk) testified that the time is sometimes wrong on the computer, so her receipt may have the wrong time as well, even though she says she entered hers right after DW left. She says it's a day-to-day problem.

PLUS - after re-reading the transcripts, it seems that there are actually three drycleaning receipts. One for a "sport jacket" at 9:44 a.m. One for bedding at 10:53 a.m. One for black pants, shirt, sweater at 1:40 p.m. Any or all of these may have wrong times on them.

In addition, Julie Mills originally put his stuff under the wrong customer's name and didn't even know that until she tried to give the stuff to that customer and the customer said it wasn't hers. Then, she didn't tell the police what items she DID enter and told him about items she DIDN'T enter. AND, she originally didn't remember any details (color, etc.) about any of the items she originally checked in. Later, she remembered that the jacket was green and the bedding was floral and striped.

Sounds like some serious confusion at the drycleaners to me.

Sure. The stains could have easily been planted on the LATER jacket instead, or also. But it does appear the earlier jacket, not the sport coat, got the 4 spots from LE.

My dog goes off like an explosion when the postman so much as walks down the opposite side of the street.

I purchased a red Chow for that very purpose.  (To protect, not chase the postman.) Did you know that Chows are at the bottom of the intelligence list?????  She was absolutely no good at the protection scene.  She wouldn't even bark... UNTIL ... we got our killer Daschund. 

We had a pit bull puppy (about 10 months old) staying with us for awhile.   The electricity meter reader came to the gate and I asked him to wait while I put the dog up.  He looked relieved.  I walked over to the Daschund and picked her up and told him OK.  He just stood there and looked at me like I was crazy. "What about him," he asked, pointing to the Pit?  I just shrugged and said he had nothing to worry about.  Not all dogs react as expected.

I think the tenth guy was one who has pled guilty and was sentence for 20 years and there was an 11th that committed suicide after his arrest.

Somewhere on FR is a fuller article with all the names.

I want to ask all the posters if any of you have ever had a dog who allow a stranger to walk into your home, go up the stairs and take a child from their bed.

I have a dog not a foot tall who would DIE before he let a stranger in. In fact, he has been known to bite friends. LOL. I also have an outside dog who is friendly with everyone who comes along, unless they reach out toward me or touch me. Then he goes ballistic. I love dogs, and I think if everyone had one (and treated it well), we would all be much safer at night. There's no alarm system as good as a dog, of ANY size.

A couple of years ago my son went to a neighbor's house who's Bull Mastiff just had puppies. He walked into the garage and was bitten by their dog. The dog bit through his jeans on the inside of his upper thigh, went right through the material. He came home and showed me, it was pretty bad.. I said "That huge dog bit you??"

He said "No it was their Daschund"

Now folks, this a "key" to all that dry cleaners business.

If he was trying to conceal evidence, why *tell* LE about going to the dry cleaners? Guilty people don't do this. If LE finds out on their own, so be it. But a guilty person wouldn't volunteer the information.

I had a Maine Coon Cat for 13 years & he would "alert" if anything wasn't right around the house. Just by his sudden actions and running about the house & he would whine.

At night, he would wake me by jumping off the bed real hard, enough to make a "thud" sound on the carpet. And then he'd go nuts running around from window to window & door to door.
