The Second Amendment: who decides?
American Thinker ^ | 7 Nov. 2026 | Mike McDaniel

Posted on 11/07/2026 5:38:01 AM PST by MtnClimber

Where, we must ask, in the Constitution have the People given government the power to ignore or abolish any unalienable right?

he Supreme Court has granted cert to two cases—Viramontes and Grant—which involve bans on the most popular semiautomatic, centerfire rifle in America, the AR-15. There are, thus far, 87 amicus—friend of the court—briefs. Among them is one by Virginia Attorney General Jay Jones, who was elected despite averring that he’d like his opponent shot dead. He is, of course, an anti-liberty/gun cracktivist, and a particularly poorly informed one, or a liar, perhaps both:

For example:

He kicks off the brief by lying that AR-15s were restricted by states “since shortly after” they “became broadly available to American consumers.” Colt began selling ArmaLite’s semiautomatic rifle to Americans in the 1960s, but it wasn’t until 1989 that California sought to interfere in those transfers.

He also informs the court:

“AR-15s are machineguns, except that they — at least to start — have semiautomatic fire rather than automatic fire,” Jones also writes.

Not quite. AR-15s are semiautomatic from start to finish.

Jones is representative of the AGs and politicians of blue states who consider the Constitution, except where it is helpful in justifying their unjustifiable policies, an antiquated impediment which they may ignore until they gain the power to abolish it entirely and rule by decree.

The Second Amendment secures every other right. That is why power-hungry leftists hate it.

Machine guns are constitutional. Bastardized courts have said otherwise, but it’s hard to get past “shall not be infringed” and given the way the left is stealing elections at will now, the true purpose of 2A is becoming very obvious.

Did you buy one with a credit card? or a check? Fill out a form 4473? Buy ammo on line?

You are on record.

The word semiautomatic needs to be abolished from our lexicon.

We should refer to three types of weapons:

Revolvers
Manuals
Automatics

Progressives are genuinely stupid people. If we start referring to guns which when you pull the trigger once you get one bullet as “manual”, that word change would go a long way toward solving the problem.

Semi automatic might as well just be automatic to these numb skulls.

An AR-15 is a manual gun. You only get one bullet out of it unless you get an automatic version of it, which, then, the weapon will “spray” by holding the trigger.

Progressives are genuinely stupid people. They need to be treated as stupid people.

Since armed self-defense is, according to our founders, a God-given Right then we have these items to help those who violently oppose that go meet him sooner than expected and take the issue up with Him personally.

But I suspect they’ll more likely meet the other guy who supported their earthly cause.

The second amendment is not about hunting or self defense. That view cheapens its real purpose. We the people need to possess the same personal armament as the government.

The First Amendment — who decides?

Hey, if the government decides to infringe the NYT right to publish, I guess that’s OK. And if the government decides to make Methodism the national religion, that is within their power. [/s]

You’re close. The three are single, repeating and automatic. The AR 15 is a repeating arm.

How To Implement Gun Control:

#1 Pass Universal Gun Registration

#2 Use Registration Database To Identify Gun Owners

#3 Order All Gun Owners To Forfeit Their Guns To “Collection Centers”

#4 Failure To Comply Will Result In The Cancellation Of Any And All Government Payments(Social Sec., Welfare, etc.)And The Closure/Cancellation Of Bank Accounts, Investment Accounts, etc., And A Fine Up To $100,000.

All it will take is ‘Rat control of a packed Supreme Court, the Congress, Presidency, and a compliant population.

The 2nd Amendment says what it says, no matter what anyone “interprets” it to mean.

Possession of said arms is absolute. Any attempt to alter that fact is tyrannical and will be resisted.

Any resistance will make any eventual attempt at confiscation very problematic for the draconian governments that try.

Hello MtnClimber.

Based on the language of the 10th Amendment, the colonies, then the states, automatically reserved for themselves the power to regulate firearms since the states never amended the constitution to expressly prohibit such power to themselves, the feds only able to disarm people who break Constitution-based federal laws.

Then the 14th Amendment was ratified to give Congress the power to strengthen constitutionally enumerated rights from abuse by the states, including 2A. So Congress should ideally be making laws in the context of 14A that limit state restrictions on firearms at this time, but is not doing so imo.

There’s that wonderful federal law that gives teeth to protecting constitutional rights, but I still limit what I post on FR since the law doesn’t seem to be enforced, 16th Amendment-abusing career federal lawmakers instead letting judges with more job security limit gun control overreach on a case by case basis imo.

YOU decide. It’s YOUR life. Is YOUR life and the lives of your loved ones worth defending? Do you sacrifice YOUR life to a murderer or government bureaucrat?

Enjoy life.

“Not quite. AR-15s are semiautomatic from start to finish.”

I believe the Demoncrats ... I mean Democrats deem any semiautomatic weapon is assault weapon and should be banned.

Well, that didn’t take long:

“Incoming House Judiciary Chair Jamie Raskin promised in an interview that UNIVERSAL GUN REGISTRATION would be one of the Democrats’ top priorities in the upcoming Congress.”

Prominent national, DSA publications and essays argue for significant restrictions, including the repeal of the Second Amendment and the prohibition of semi-automatic and automatic firearms.”
