Lindsay Clancy’s lawyer files Hail Mary bid for ‘not guilty by reason of insanity’ ruling — despite hung jury

Lindsay Clancy’s lawyer officially filed a Hail Mary bid Thursday asking a judge to find his killer client not guilty by reason of insanity – despite her high-profile case ending with a hung jury.

Defense lawyer Kevin Reddington argued in new court papers that prosecutors at her widely watched five-week trial failed to prove that the 36-year-old Duxbury, Massachusetts, mother knew what she was doing was wrong and could follow the law when she strangled her three kids on Jan. 24, 2023.

“No rational jury could find beyond a reasonable doubt that she had no mental disease or defect when the Commonwealth’s own proof established that she did,” Reddington, 75, wrote in the papers.

The veteran defense attorney says he plans to argue his motion further at Clancy’s next hearing on Sept. 29, when a new trial date could be set for her.

Reddington asked the jury to find Clancy – a former labor and delivery nurse – not criminally responsible, claiming she was suffering from severe postpartum psychosis and hallucinated a voice forcing her to kill Cora, 5, Dawson, 3, and Callan, 8 months, before she attempted suicide.

However, prosecutors alleged she was lucid enough to carefully plan and execute the horrific crimes.

About 25% of women have mental defects that would justify professional care.

That doesn’t mean they get to murder without consequence.

The mental health experts are expanding the definition of mental disease or defect to be anything. It increases their customer base.

I’m certainly no lawyer, but was there a verdict? It’s a hung jury because no verdict was reached. Can the judge decide to set aside something which does not exist?

I, too, am no lawyer, but does Massachusetts law require the prosecution to prove a negative when it comes to mental disease/defect?

Not a hung jury - mistrial was declared. No, I do not lnow the difference, just that there is a difference in legal terms.

And neither could the medical profession as there were at least a half dozen doctors, so far, that were prescribing medication and treating her for mental illness. This plea should have been filed to begin with. She had all kinds of evidence that she did it and was being teated for the mental problems. Possibly overtreated.

I shake my head at the goofballs who keep telling people that if Lindsay had won the NG by reason of insanity verdict it wouldn’t mean she just gets to roll out and go back to living like she did nothing.

She would be put in a mental care facility until it was deemed she was well enough to be released.

Oh okay, they always add in how that could be many many years. Maybe that is true, but what they don’t say it that it could also be 6 months from now.

What they also don’t say is that going to the mental facility is a joke because she would be treated by the same type people she claims did not help her. I also find it interesting that she has filed a civil suit against those very same type doctors. What for? Cash to go out and start again after murdering those babies of hers?
