Hung jury?
If I understand correctly, the DA would then have to decide whether to re-file the charges and try the case again.
Given public pressure and the media spotlight, perhaps the case wouldn’t be tried again? We’ll see.
They’ll retry it...the court tv people are pretty sure of it.
I doubt very much that they’d abandon the case. They would re-try.
(If somehow a partial verdict was allowed, I have no idea what would happen with charges not decided.)
The defense is going to file an appeal that the hung juror should be replaced and deliberations should continue. The basis is the belief by the defense that the juror was unwilling to follow the Judge’s instructions.
So, the jury will be sent home. The Supreme Judical Court (The MA Supreme Court) will rule on it…(on Labor Day weekend—good luck with that) and we pick it back up on Tuesday.
This case is a mess and should have been settled before it even got to court.
I can’t see another trial. If they were down 11-1, how do they get to 12-0?
Maybe the Corie A Walsh case in Illinois helps the sentiment for the prosecution?
