PLYMOUTH, Mass. – A judge declared a mistrial in Lindsay Clancy’s murder trial Friday on the seventh day of deliberations — but gave her defiant lawyer one hour to file an emergency appeal against the ruling.
The 12-person jury – made up of nine women and three men – told Judge William Sullivan that they could not agree on whether to convict Clancy, 36, of three counts of first-degree murder.

Not correct. Judge said he WILL declare a mistrial. But he gave the defense one hour to get a court of appeals ruling to stay the announcement of a mistrial.
Given this is happening in MASS, I would not be surprised if the Appeals Court Judge grants the request from the Defense.

Massachusetts is just whack! If the defense is going to claim insanity, then the burden should be on them. The burdern to prove otherwise should not be on the Commonwealth.

I doubt very much that they’d abandon the case. They would re-try.

According to Newsmax, we should know something definite in about 30 minutes. Holy moly, this is unnerving. I think the mistrial will hold, but we’ll soon see.

Not to me. My opinion on that is one person didn’t want to let what they believed was a murderer go free so the best they could do was hang the jury.

Not just the men... the women need to have their ‘human cards’ revoked. Whatever happened to that motherly instinct? Or is Massachusetts now immune to any logic, reason or good.
I think they would retry depending on negotiations with the defense. After a mistrial I would bet they’d offer to accept a plea of three counts of second degree. If she refuses then I think they would retry for three counts of first degree.
