The U.S. court system is 100% broken, and nothing shows that fact better than this case out of Pennsylvania.
Safon Gump was accused of fatally shooting Gregory Prince, but the trial that would have brought justice to Gump derailed because one of the jurors got high in the jury room.
Because Gump remains in custody — and court rules prohibit jurors from seeing a defendant in handcuffs for fear it could prejudice them — jurors were returned to their fifth-floor room to await the all clear to leave for lunch.
When Common Pleas Judge Edward J. Borkowski's tipstaff arrived to release the jurors, Seman said, ‘He's immediately hit with the smell of marijuana.'
Then, one of the jurors ‘looked at him and said, 'It wasn't me."'
This is where things really went off the rails.
The prosecution and the defense both agreed that if the juror had a prescription it was fine, and the judge said no one would be in trouble for the incident, but all the jurors also swore that they were not taking any medications that could affect their judgment in the case, so the judge needed to figure out who it was.
One by one, the jurors were brought to the judge's chambers privately and questioned.
They all answered no in chambers, as well.
The judge also asked the jurors if anyone had ingested anything legally or illegally while in the jury room.
‘All of them denied it,' Seman said.
The defense asked for a mistrial and the judge agreed to it.
Another potential murderer is back out on the streets — at least, until March, when they'll try a trial again.

Nice. Now look for all of them to light up in the jury room to get their brothers set free.
That takes a special kind of stupid.
Q: Why was he set free?
A: He only killed a commoner.
He did it.

Uhm, pick the one that smells like he keeps a skunk in his pocket.
During a traffic stop where pot is found and no one declares ownership, everyone in the vehicle gets popped for it. Lock ‘em up.
This is a funny story but on a more serious note, I have heard many stories - dozens - of defendants going to court for DUI or other alcohol or drug-related offenses while drunk or high. One judge in Philadelphia looked at a defendant who was falling asleep in court and said “I want to know what is wrong with him!” Its a common occurrence for defendants with substance abuse related offenses to show up intoxicated or at least buzzed.
It could have been worse...it could have happened in Florida.
I would have pointed out who did it(only if I knew it for sure) and swear an oath in court!...It is ridiculous to let a potential murderer go free...I say potential because the defendant has the presumption of innocence.
This being the first sentence negates the entire article. This is what passes for reporting these days. Just a bunch of nonsensical hyperbole for clicks.
Ended up with a dui myself back in 1982. Part of paying my penance was a 4 night driving course.
The instructor made very clear two things the first night.
She was a ward of the court and nobody better show up impaired, she was trained to detect it and doing so would mean immediate return to the judge for being in contempt.
The last night a dumpy little biker dude that was in the class came in late and the whole class could tell he was half in the bag. Only chair left was right next to the instructors podium.
He sat down, looked at her and said “am I late?” The whole class cringed.
She told him to come with her to her office.
A few minutes later he came out with a legal size document and a sick look on his face and left.
Dude couldn’t hold off just a few hours longer. SMH
They ALL did it. It was a joint decision.
