Texas judge denies Karmelo Anthony's bid for a retrial

After Anthony's lawyers tried to argue that the trial was unfair to Anthony because there were no black people on the jury, among other reasons, a Texas judge dismissed the request with no hesitation.

A Texas judge has denied a bid for a new trial for Karmelo Anthony, who had been sentenced to 35 years in prison for fatally stabbing a fellow student at a high school track meet.

Retired Kaufman County District Judge Michael Chitty denied Anthony's motion for a new trial, which had alleged in part that a 'gentleman's agreement' between the trial attorneys impacted his ability to testify in his own defense.

'Upon reviewing the motion, the record, the evidence and argument, the briefs, and the relevant case law, the Court has determined the motion should be denied,' Chitty wrote in a brief order on Saturday.

The defense still has nothing.

But Anthony's attorneys say they will continue to seek all avenues for appeal.

The Texas DA who prosecuted Anthony had this to say about the latest ruling:

In a statement, Collin County District Attorney Greg Willis: 'We respect, and expected, the court's decision denying the motion for a new trial. The jury's guilty verdict stands, and we remain confident in the process. Every defendant has the right to appeal, and our thoughts and prayers remain with the Metcalf family in the painful wake of last week's hearing.'

I don't think the appeals will find friendly judges in Texas.

This is not a big deal or a big win. After EVERY trial, EVERY criminal defense lawyer files a motion for a new trial as a prerequisite to being able to file an appeal at the the appellate level. These are summarily denied in the vast majority of cases.

The “gentlemen’s agreement “ he complained about was mostly in his favor. The DA informed the judge of a slew of evidence not presented that would have 100% proved it was premeditated murder. This spared this Karmelo fiend the death sentence.

I was sort of hoping it would go back to trial for murder one.

That scam for “legal funds” is a sad product of that culture. If you want something, take it. It doesn’t matter from whom or why. Just take it. Then… buy expensive new cars. New suits with matching fedora and a feather. Gold grill to make for an impressive smile. You know. The whole classy 9 yards.

It’s been my observation for some time now that black people have developed a knack for turning the death or other negative situation of a family member into some sort of windfall.

Their first move is always a donation website.

Supposedly they have already filed another appeal. Though it isn’t an appeal for a retrial.
Little Melo needs to accept the fate he chose for his rotten self.

I agree with you !! IF it goes to a new trial, the “gentleman’s agreement” (which was ridiculous in the first place) would pain him in a very different light and would likely result in Murder 1 and the death sentence in Texas (with any justice at all!)

The case the defense was actually trying to make is that non-black jurors are incapable of administering justice.

That is about as disgustingly racist as it can get.
