A Whitby father who got a two-year house arrest and three years of probation for firing at armed home intruders who shot his son won’t face a longer sentence after it was upheld.
Last week, the Court of Appeal for Ontario dismissed the Crown’s appeal of the length of the man’s sentence, which they argued as “demonstrably unfit.”
A panel of three Ontario Court of Appeal judges, however, stated they saw “no error” in the sentence.
“Nor do we find that the sentence was manifestly unfit,” the appeal judges added.
The appeal decision, published online earlier this week, detailed the incident that occurred in Jason Munroe’s home in Whitby as well as what happened in the trial.
After entering the home, the intruders forced Munroe and his family into the basement. Shortly after, there was an altercation that resulted in Munroe’s son being shot.
Munroe then wrestled a handgun from one intruder and shot one of them.
The intruders fled the home, but Munroe chased after them. He stood on his porch and shot at them three times while they were fleeing in their car.
No one was hit.
During his trial in 2025, Justice Nathan N. Baker found Munroe not guilty of the charges related to what occurred in the house, as he was satisfied Munroe was acting in self-defence.
Baker did find Munroe guilty of reckless discharge of a restricted or prohibited firearm for shooting at the intruders from his porch. The Whitby father was also convicted of obstruction of a peace officer for lying in his initial police statement.
The judge handed Munroe a conditional sentence of 729 days followed by three years of probation. Baker argued the five-year mandatory minimum sentence for the reckless discharge of a firearm was unconstitutional if applied to Munroe’s case.

Wow...”reckless discharge of a restricted or prohibited firearm” — the gun that the intruders brought to the house! The homeowner wrested it away from the criminals and used it to shoot one of them. It was not even his own gun!

I get that the father’s adrenaline was pumping. But that was a bit much.
So I’m actually (and pleasantly) surprised that Canada did not throw him in prison for 10 years.

I am not familiar with Canadian law.
Prosecutors need to be required to prove that (gun-trained?) defendant had a safe, lawful, property-protecting way out of a possibly injurious or deadly situation before defendant can be found guilty of "unlawful" use of firearm.
There are YouTube videos about people who were killed in their homes while asking 911 for help.
Effective jury nullification seems to be absent in Canadian courts imo.
I propose, life in prison …… FOR THE JUDGES!!!
