U.S. Trade Representative Jamieson Greer on Sunday said the Trump administration would need guidance from the courts on how to handle tariff refunds after the Supreme Court struck down duties authorized under the International Emergency Economic Powers Act.
“Well, we need the court to tell us what to do. They’ve created a situation where they struck down the tariffs and gave zero guidance on this,” Greer said during an appearance on ABC’s “This Week.” “Historically, you know, as a trade attorney, in my experience, courts will normally give you some instruction on what to do, when.”
“The Court of International Trade, which is a district level U.S. court, my expectation is that they’ll have to step in and give some direction on how they want that to be done, if at all, whether plaintiffs had to have made the claim or not. We just need to have guidance from the court,” he added.
Tariffs have generated approximately $142 billion in revenue for the U.S.. In response to the SCOTUS ruling, Trump implemented a 15 percent global tariff and is evaluating different trade authorizations to maintain current rates imposed on specific countries.
The Supreme Court ruling striking IEEPA tariffs came weeks before Trump’s slated to meet with Chinese President Xi Jinping.
“Going into this meeting, the purpose of the meeting with President Xi is not to — it’s not to fight about trade, it’s to maintain stability, make sure that the Chinese are holding up their end of our deal and buying American, you know, agricultural products and Boeings (ph) and other things and making sure they’re sending us the rare earth that we need,” Greer said.
“It’s really about monitoring that agreement. If there are places for additional agreement, we’ll find them. And developing the president’s relationship with each other,” he added.

The court does not provide guidance and neither do they address the whole law. Instead they just answer specific law on a specific question. The court does not pretend or intend to be efficient or helpful. For them “the law” takes on sacred form and more-so when they are elevated to god like power in the USSC. That is all that justifies their inordinate power over mere mortals like us.
The court answers questions about like AI does vague, slanted and specific. You have to frame the question right.
The court didn’t create the situation. Trump did. And the ad hoc 150 day tariffs are a panic response to try and cover the coming refunds.
Hand all the tariff money to the SC and tell them to dole it out. Idiots.
SCOTUS are a joke.

The court should have stayed in its lane. This is a matter between the Congress and the POTUS. The moron chief justice doesn’t even know what a tariff is and he’s opining on it. A tariff is not a tax.
Cut SCOTUS budget by 95% and pay the refund over time...a LONG time.

Many of the current justices are not qualified to participate in the big league.
Roberts legacy will be as an embarrassment to American jurisprudence. Obamacare is a tax...The president can embargo but not tariff in emergencies...and many more questionable politically tainted rulings. Now Roberts’ relations with Eisen are in the spotlight. Perhaps he will “retire” soon.

President Trump recently revoked Eisen’s security clearance, together with that of other “lawfare” operatives.

If those “ tariffs” were really passed to millions of consumers…then who really has standing and how is it to be calculated?
I think the Trump response to the big exporters was “ See you in court for the next 5 years and oh, by the way, here’s a new tariff…”
My real estate clients evaluate the possible outcomes of their work and develop backup plans for every contingency so they are ready when something fails. Trump is a real estate guy, he didn't implement this 150 day tariff in a panic.
