Court Ruling Allows California Abuse Claims Against Steven Tyler to Proceed

Steven Tyler's attorneys can claim partial victory in a new court ruling as arguments continue in a child sex-abuse lawsuit brought by the former Julia Holcomb.

Los Angeles County Judge Patricia A. Young has dismissed claims of alleged abuse in Oregon, Washington and Massachusetts, citing laws governing the age of consent and the statute of limitations. Crucially, however, the California-based charges against Aerosmith's frontman can go forward.

In terminating the other claims, Judge Young would apparently stop them from being refiled again. She promised a written decision soon. "I have clearly signaled how I intend" to rule, Young said from the bench. "I'm not moving the trial."

Holcomb, who now goes by Julia Misley after marrying, says the then-25-year-old Tyler began abusing her while on tour in the early '70s when she was a high school sophomore. They first met backstage in Portland, Misley said in the lawsuit. She said they had sex the next night in Seattle. In both cases, the age of consent at the time was 18.

"I was treated like a sex toy," Misley said during depositions. "I was treated like a pet, like a thing, and it was humiliating."

A subsequent encounter in California was recounted in Tyler's autobiography, 2011's Does the Noise in My Head Bother You?, though he did not name Misley. Tyler eventually became her legal guardian during a three-year relationship in which Misley says she was groomed.

"I went and slept at her parents' house for a couple of nights," Tyler wrote in his memoir, "and her parents fell in love with me, signed papers over for me to have custody, so I wouldn't get arrested if I took her out of state." Misley, meanwhile, said she'd become "lost in a rock and roll culture" as an impressionable teen.

Tyler's lawyers denied the abuse claims and asked that her December 2022 lawsuit be dismissed on the grounds that she moved in with him in Boston, where the age of consent was 16. The judge, however, ruled that local laws governed his actions when they traveled together outside of Massachusetts.

Misley brought this action after California passed 2019's Child Victim's Act, which gave survivors a three-year window to make older claims. Young said her assertion that Tyler sexually abused her at a Beverly Hills hotel while on tour was valid enough to proceed.

"Even if it's legal in Massachusetts, California has an interest in saying, 'OK, that's fine but it's illegal here. Don't come within our borders and do it here," Judge Young argued in court. "California absolutely has an interest in people coming into our state, committing a crime here, such as childhood sexual abuse, and then leaving again."

A second woman later filed suit against Tyler again alleging sexual assault as a teen, but those claims have since been dismissed.

Often you can’t. But this is a lawsuit, and the standards are going to be different than in a criminal charge. Unfortunately people like E. Jean Carroll are getting away with this crap.

I read this book. If true (and there seems to be overwhelming evidence) her hideous parents gave him legal guardianship and he took her with him for three years as a bang maid very much underage. He got her pregnant and forced an abortion as well. I hope they throw the book at this evil man. Poor kid. Her “parents” are criminal too afaic

I think he was done with her after the three years moved on to the next teen.

There is plenty of physical documentation and scores of witnesses.

Normally I don’t support decades old accusations but this one has more than necessary evidence.

This law (and many similar laws) were passed specifically with the expectation that a bunch of former Miss Teen USA models would come forward with claims of sexual abuse against President Trump.

Steven Tyler is collateral damage.

Calling an abandoned teenage girl a crew slut is heartbreaking. This “conservative” site has too many who blame minors for their abuse. It really gives me pause.

Her parents legally handed her over. She was indeed according to her book excited to go in tour and thought she and Tyler were in love. Typical of groomed, abandoned and abused teens. That’s how the game is played.

As an adult she began to realize that what happened to her was nothing but a three year abuse session. As an adult I have also looked back on things I accepted as a kid and realized good grief those people were total predators they severely harmed and endangered me.

Minors don’t protect themselves. They are usually frankly too naive and undiscerning. That’s why they are considered minors and don’t have agency.

I am unsure how young a person has to be before you begin to believe they can not be consenting.

And if all she can do is hold him accountable in this way at this time I wish her all success. This rock start/teen groupie acceptance has got to stop.

She knew what she was doing. She knew what she wanted, the high life and excitement. She got that and now she was money for her bad decisions.

She should sue her parents. They are equally guilty for their bad decisions.

Then how many decades do you suppose it should take to realize what happened and do something about it? E. Jean Carroll pulled a similar trick with Trump - with no real proof at all, and after DECADES, she dragged the President through a laughingstock of a lawsuit - and the court let her win. Our legal system has become very corrupt, and that's as dangerous as anything.

I agree and have posted that allegations about decades old behavior should not be entertained. Anyone can accuse anyone of anything. We have the presumption of innocence.

In this case we have legal documentation and medical documentation and scores if not hundreds of witnesses. Rare but totally damning. I do believe Tyler is even on record discussing his exploits (confession). So, not the same thing.

When I was around 16 I went to a women’s club dance for teens with my friends in Jax. Billy Joe Royal was there playing with his band. I was dancing for quite a long time right in front of the stage.

Later a guy with the band came over and said Billy Joe wanted to invite me back stage to meet me. I told the guy thanks but we were getting ready to leave. We all knew the score.

If I am understanding the CA law, she had until she was 40 to file charges. Why didn’t she?

I think a 40 year old woman is mature enough to realize what happened to her and do something about it.
