Judge dismisses cases against ex-FBI Director James Comey, NY AG Tish James

A federal judge dismissed the Virginia criminal cases against former FBI Director James Comey and New York Attorney General Letitia James on Monday, finding that interim US Attorney Lindsey Halligan was improperly appointed to her position and “had no lawful authority” to secure indictments of either of President Trump’s longtime adversaries.

The humiliating defeat for the administration came 11 days after attorneys for both Comey and James had argued that Halligan had to be confirmed by the Senate after Attorney General Pam Bondi used up her allotted 120-day interim appointment on Erik Siebert, who resigned Sept. 19 after Trump publicly criticized him for not bringing charges against the former head of the FBI.

The nature of the charges wasn’t disputed. Just Halligan’s appointment. Comey may now slide on statute of limitations, though.

You would think a guy who had a TV program that specialized in saying “You’re Fired” would know better, especially the second time around.

What happened to America First?

Blondi is feckless. Trump needed a seasoned, tough AG and FBI chief. He got neither.

Will Chamberlain, of the Article III Project says these dismaissals will be overturned in the Appeaals court, and if not there in the Supreme Counrt. But he fully expects that it will happen in the Appeals Court. He aslo said the the expiration date resets to another 6 months because the dimisal occured on a case having an indictment.

So, as Yogi Berra said; it ain't over until its over.

Let's all take a deep breath, relax and see how this plays out.

Just like all the 2020 STEAL court cases were swept aside and not a eep of the evidence (the rest of the story) ever got daylit.
Oh how the fake news is fawning over this glimmer gem that they and theirs have hatched out this day, one judge? You Do Say?

These Federal courts drag on for years. Rulings on minutia take 12 months.
It’s a tell when they move quickly. A real Tell.

They haven’t even moved on the fake case in NY where they ignored statutes and the Constitution to get Trump in an unprecedented move.

Criminal court system is corrupted. Military tribunals will be needed to get any justice.

It’s a procedure thing. The judge pulled what Judge Cannon did to Jack Smith and said that the DOJ girl doesn’t exist.

DOJ will appeal.

Trump’s DOJ is the weakest in history - Jackie Chiles from Seinfeld would be more effective as AG.

28 U.S.C. § 546 - U.S. Code - Unannotated Title 28. Judiciary and Judicial Procedure § 546. Vacancies

(a) Except as provided in subsection (b), the Attorney General may appoint a United States attorney for the district in which the office of United States attorney is vacant.

(b) The Attorney General shall not appoint as United States attorney a person to whose appointment by the President to that office the Senate refused to give advice and consent.

(c) A person appointed as United States attorney under this section may serve until the earlier of—

(1) the qualification of a United States attorney for such district appointed by the President under section 541 of this title; or

(2) the expiration of 120 days after appointment by the Attorney General under this section.

(d) If an appointment expires under subsection (c)(2), the district court for such district may appoint a United States attorney to serve until the vacancy is filled. The order of appointment by the court shall be filed with the clerk of the court.

Erik Siebert’s appointment started the clock running. The executive branch is not allowed to fill the post with revolving interims.

Why not just declare a dictatorship and be done with it? Republics aren’t governed by military tribunals.

Why is anyone surprised by this? Everything that seems to be “the right thing to do” in Washington is never much more than performance or theatrics. The only substantial thing that’s done in Washington is the looting of the nation’s wealth.

I saw where he say that the indictments can be refiled (which makes sense,) but I haven’t found where he expects the decisions to be overturned. I’d like to know his reasoning.

A strict reading of 28 U.S.C. § 546 makes Halligan’s appointment invalid.
