The U.S. Chamber of Commerce has filed a legal challenge to the Trump administration’s $100,000 fee on new H-1B visa applications, saying it overrides existing provisions in current laws that apply to the H-1B programme.
“The Chamber’s litigation argues that the new fee is unlawful because it overrides provisions of the Immigration and Nationality Act that govern the H-1B program, including the requirement that fees be based on the costs incurred by the government in processing visas,” the Chamber said in a statement on October 16.
The Trump administration announced a $100,000 fee on fresh H-1B visa applications. This was aimed at undoing the apparent trend of US employers replacing American workers with cheaper labour found overseas.
However, the H-1B programme was designed for jobs of high skill for which companies find it difficult to find local talent.
“The new $100,000 visa fee will make it cost-prohibitive for U.S. employers, especially start-ups and small and midsize businesses, to utilise the H-1B program, which was created by Congress expressly to ensure that American businesses of all sizes can access the global talent they need to grow their operations here in the U.S,” Neil Bradley, Executive Vice President and Chief Policy Officer at the U.S. Chamber of Commerce said..

If these people are so highly skilled and indispensable, filling critical jobs, then $100,000 fee for a visa shouldn’t be a problem.
Charging a large fee for such a visa actually makes a lot of sense. It’s a litmus test and if an employer really needs such a valuable and highly skilled employee, then paying that fee shouldn’t be a problem.
The point of the H1B wasn’t for Disney to bring in folks working a concession stand.
“No standing.”
No standing is a way for a judge to not deal with something he doesn’t want to deal with. It is usually an arbitrary political decision. Usually, it allows the situation the judge prefers to continue. If I challenged something Trump had done even though I have no relation to it, there’s a good chance the “right” judge would allow the case. He might be reversed, but as my lawyer said, “Once it gets in front of a judge, regardless of merit, it’s a crap shoot.”

The Chamber is an expensive do-nothing organ. Why are they not helping Americans to get into such positions. Their legal fees could be scholarships.
Our local Rotary dropped out of Rotary International. It is now called The Noon Club. Same guys, same time, same fundraisers, but they are spending it all in our community. Very lively club.
