Chamber of Commerce Sues Over Trump’s New $100,000 H-1B Visa Fee

The U.S. Chamber of Commerce sued the Trump administration Thursday over hefty new fees in the H-1B visa program, joining the legal campaign against the administration’s changes to a program used by some of the biggest tech companies in the U.S.

The chamber’s lawsuit is seeking to block the new H-1B program restrictions, which were rolled out in a presidential proclamation that the chamber says “is not only misguided policy; it is plainly unlawful.”

“The President has significant authority over the entry of noncitizens into the United States, but that authority is bounded by statute and cannot directly contradict laws passed by Congress,” it said in a complaint filed in federal court in Washington, D.C.

“The Proclamation does precisely that: It blatantly contravenes the fees Congress has set for the H-1B program and countermands Congress’s judgment.”

A White House spokeswoman said Thursday that the administration’s actions were lawful and “a necessary, initial, incremental step” to change the H-1B program.

“The new $100,000 visa fee will make it cost-prohibitive for U.S. employers, especially start-ups and small and midsize businesses, to utilize the H-1B program, which was created by Congress expressly to ensure that American businesses of all sizes can access the global talent they need to grow their operations here in the U.S.,” said Neil Bradley, executive vice president and chief policy officer at the chamber.

$100,000 is a drop in the bucket, if you are hiring some real expert.
Just signing bonus and relocation expenses, often not even that.
So, if you cannot afford it, you obviously shopping for some cheap body to undercut competition.

I loath the Chamber of Commerce. They’re anti-gun, anti-free speech, and probably anti all the rest of the bill of rights. Near as I can tell their main purpose is to cozy up to government to get special consideration for their main members.

Critics of the $100,000 H1B fee never point out that most H1Bs work in the USA for six years on one visa!

In other words...

The H1B costs a USA corporation $16,600 - per year - more than it used to.

H1B workers that get sponsored for a USA Green Card can be here for 9 years or longer.

Foreign Doctors and Dentists get sponsored for a Green Card almost immediately after arriving in the USA.

USA universities, non-profit laboratories, and city, state, and federal government agencies, can hire an unlimited number of H1Bs, in addition to the fantasy H1B 510,000 six year quota.
