Deported to India: Sikh grandmother spent three decades in Bay Area before ICE arrest

A SIKH GRANDMOTHER who had lived in the U.S. for more than 30 years has been deported to New Delhi, India, after spending a week in what her attorney called “barbaric” conditions at a private ICE detention center in Georgia.

“There was no rationale to detain Bibi Harjit Kaur,” Deepak Ahluwalia, Kaur’s attorney, told American Community Media in a Sept. 24 interview. “It’s all part of their effort to fill beds.”

“Her detention was nothing short of barbaric,” said Ahluwalia. “That type of treatment would affect most people. They chose to do this to a 73-year-old woman with disabilities and health issues.”

The elderly woman was initially taken to a U.S. Immigration and Customs Enforcement detention center in Bakersfield and then transferred to the Stewart Detention Center in Lumpkin, Georgia. Neither her family nor Ahluwalia was informed of the transfer.

“Her detention was nothing short of barbaric,” said Ahluwalia. “That type of treatment would affect most people. They chose to do this to a 73-year-old woman with disabilities and health issues.”

No water, harsh conditions

Kaur was not given water to take her medications, according to Ahluwalia. When she asked for water, she was given a plate of ice instead, which she could not chew because of her dentures. In Lumpkin, Kaur was forced to sleep on the floor in a crowded detention facility; she could not easily get up from the floor, as she had surgery on both knees. The strict vegetarian got only meat-based meals for her first six days in detention. She was handcuffed numerous times during transfers.

Consequences of Visa Overstay in India
Remaining in India past the expiry date of a valid visa, even for a single day, is a criminal offense under the Indian Foreigners Act of 1946. The legal consequences can be severe.

1. Immediate Legal and Financial Penalties
Hefty Fines: You are subject to mandatory fines, which increase significantly based on the duration of the overstay. Fines typically range from several hundred USD and up.
Mandatory Exit Permit: You must obtain an Exit Permit from the nearest FRRO (Foreign Regional Registration Office) before you will be allowed to leave the country. This process is time-consuming and required for departure.
Detention: For severe or intentional overstays, authorities have the power to detain and begin formal deportation proceedings.
2. Criminal Charges and Imprisonment Risk
Overstaying is a criminal matter, not just a fineable offense.

Imprisonment: Under Section 14 of the Foreigners Act, a foreigner overstaying a visa can face penalties that include imprisonment for up to five years, in addition to heavy fines.
Prosecution: If the overstay is linked to other illegal activities or is deemed fraudulent, formal criminal prosecution is a serious risk.
3. Long-Term Immigration Record Damage
Blacklisting/Re-entry Ban: The overstay will likely result in you being blacklisted from India, meaning a ban on future travel for several years, or permanently in serious cases.
Future Visa Denial: The violation is permanently logged and will be a major red flag on all future Indian visa applications, making approval highly unlikely.

Crucial Advice: If a visa is expired, the most important step is to immediately contact the nearest FRRO office to begin the process for the Exit Permit.

The full story indicates she could not be sponsored by her family because that is prohibited while she is in the US. The story continues that she has been here for 30 years living and working in the community, making friends ...

Yet, not one of those friends would sponsor her. Sure, seems legit!

Why don’t we use the exact laws countries have for immigration, welfare and property ownership for them????

Mexican immigration laws are very strict and certainly don’t give out welfare to Americans.

Start imprisoning people and MAKE THEM EARN THEIR KEEP BEHIND BARS. You want to be here so badly and get welfare???? YOU GOT IT. Now make those traffic signs!!!! And enjoy your bologna sammich!!!!

A foreign citizen seeking to live permanently in the United States requires an immigrant visa (IV). To be eligible to apply for an IV, a foreign citizen must be sponsored by an immediate relative who is at least 21 years of age and is either a U.S. citizen or U.S. Lawful Permanent Resident (that is, a green-card holder).

You just know she got Medicaid and was probably on disability somehow. Subsidized housing, free food, cash money - she either had money in India or was in the gutter.

She should have been made to repay every single penny she stole from us before she was evicted back to her sh!thole country.

They should have a website specifically for that. For every single one they arrest. Drill it down to what their anchor babies have collected. Maybe then the American public would get an idea of how much they are sucking out of this country.

Who knows if this story is even true? I believe so little of what I read nowadays. In any case, if you are in the country illegally, then getting deported shouldn’t be a shock
