H-1B Visa Filings Under Scrutiny: What Led Senators To Investigate TCS And Big Tech

US senators Charles Grassley and Richard Durbin have raised concerns about major corporations, including Tata Consultancy Services (TCS) and Cognizant, for filing thousands of H-1B skilled worker visa petitions even as they conducted large-scale layoffs of American employees.

Other companies questioned include Amazon, Apple, Deloitte, Google, JPMorgan Chase, Meta, Microsoft, and Walmart.

The inquiry comes amid high unemployment in the US tech sector, which exceeds the overall national jobless rate. Recent American graduates with STEM degrees are reportedly struggling to find jobs, prompting the senators to question why companies are replacing US workers with foreign visa holders, as per PTI reports.

Allegations Against TCS And Cognizant

TCS announced plans to lay off over 12,000 employees, including Americans, while applying to hire 5,505 foreign H-1B workers in 2025. The company is also under investigation by the Equal Employment Opportunity Commission for allegedly replacing older American staff with H-1B visa holders.

Cognizant similarly laid off thousands of workers and applied for 2,493 H-1B employees. A 2024 federal jury found Cognizant favored South Asian H-1B workers over American staff, resulting in punitive damages.

Other Tech Companies Under Scrutiny

Amazon laid off tens of thousands of employees while applying for 10,044 H-1B visas. Google cut large numbers of employees, including managers, and applied for 4,181 foreign hires.

Meta laid off 3,600 employees while applying for 5,123 H-1B workers. Microsoft laid off 16,000 employees but applied for 5,189 H-1B visas despite reporting record profits.

Hopefully something is done about the Indian invasion before it’s too late. We should just end the their h1b visa scam anyways

Well i can tell you! Here at ncfast/ncdhhs we hired 100s of them. Wound out 1 guy was practically taking the technical interviews for all of them! After a long long while managers had to admit they hired h1bs that didn’t know crap and couldn’t code in curam environment.

Lovely granular detail in the article. Amazon is number one! As tallied by the WSJ, Amazon is number one by Amazon is "14.667" while Tata Consultancy Services comes to "5,586."

Amazon is the winner, and still reigning champion!

This may be very naive, but why do we have an H1-B visa program? If Microsoft, Amazon, Tesla and the other large companies feel they have to hire the “best” engineers and computer scientists who all come from Inida, why don’t they hire them in India? There is no need to bring them to the US. They can work from India.
