Almost. Whether it misses by 1 ft or 1 mile it is a miss.

I had the same thing happen to me as I was touching down when a skydive operator landed over the top of me in his King Air. I reported him to the FAA then found out he gave free jumps to the FAA guys so nothing happened but a warning.
He did the same thing to another pilot not too long after and the guy went up and punched his lights out.
