I think that the problem comes down to what is an emergency. A sneak attack or other sudden action that threatens national security requires giving the Executive immediate authority.

Whatever one thinks of the state of the American worker and the American economy, there is nothing that has suddenly escalated: they are endemic problems that can be addressed (if the Administration's appeals fail) by legislation.

37 trillion and growing is indeed a national emergency. Combine that with the BRICS world working as quickly as they can to divest from the dollar. It’s the pinnacle of stupidity not to think our economic situation it’s not a national emergency at this point.

There is no legal basis. It’s simply an anti-Trump measure of the swamp defending itself. It’s not based on the definition of a national emergency. The list of national emergencies is filled with things far less compelling.
